Time to get some questions answered, was he taken off active duty after the first arrest, was he at work? The reports are he was still under investigation for the first incident, time to see if he was acting in the capacity of a civilian or on duty? Doubtful, he must have been placed on leave after the first incident. Was he getting any help from Mitchell? Or did Mitchell as usual just blow him off. This is not pretty.
 

My point was that the rank and file endorsed Mitchell for sheriff. That tells me allot about them. I already know Mitchell.So there is not only lost trust with Mitchell but all that would support him. Sorry about any confusion. The fact is this mess is of their making When they started to lie. Keeping Mitchell is a pox and will only get worse with out his removal. For what ever I am, you put no money in my pocket, I did not try to rail road a citizen for someone else. Wait a minute we just did a side by side photo comparison of Byron Smith, from his first arrest in June to last nights...The photos are exactly the same, they have used the photo from the first arrest for last nights arrest. WTF???? Why would that be? Anybody? Why is there always these strange situations with Mitchell and his boys???
 

I used to work with Bryan and thought he was an arrogant little Sh*t, and knew there was an "issue" way back when, and I felt a "little bit" bad when he got nailed when he wrecked the patrol car, but it was an issue that should have been caught along time ago... and now with him getting popped for DUI of whatever nature... I feel bad for the kid.

He has destroyed his life, he has self destructed. He balanced out his weakness with the strength of the Badge that he thought would protect him. And once again, Rod was in his Office playing Farmville on the Computer (or whatever the hell he does behind closed doors) and oblivious to his employee's and many issues that could have been caught, and dealt with early on. And Bryan's friends did him NO FAVORS by keeping silent about his "issues".

We all have our weakness's, none of us have lived a perfect life, and all made mistakes.
And if most people knew who I was, writing this, there would be lots of dis-belief and a possible stroke or two.

I hope Bryan gets the help he needs, and looks to a brighter chapter in his life and close the door on this one. Live and Learn.. Just don't repeat your mistakes. Sorry, it's the motherly side of me. My heart does go out to the kid right now. I hope someone steps up to the plate and helps this kid get the help he obviously needs. I do wish him all the best. Ski is a good man, but I have a very big problem with him taking a life and then jumping around giving out shirts for Mitchell the next day. Taking a life is a very serious act and most cops who do this go through some emotional hardships. Don't take my word for it, ask Don Anderson or any cop who has been to a police funeral. The taking of a life should be the hardest thing a person can do. Even in the military, a lot of military personnel go through mental problems after taking a life (known as Post Traumatic Stress Syndrome).

Like I said, Ski is a good cop, I respect him and believe the shooting was completely justified, but his actions afterwords is very disturbing. Also Mitchell's actions by having Ski handing out shirts after killing someone from that area is the sign of a very emotionally disturbed person who only cares about himself.

I believe Rivero will most likely bring this up during the election. Not that the shooting was questionable, but Mitchell putting Ski in that position the next day. Very disturbing....
 

Facts are the facts for those of you that want to disparage the coverage of the news in this county. We know these are two more hard and damaging hits against Mitchell, but it is the card you are dealt with your leader Mitchell. Was Mitchell getting help for one his employees? Or does he just cast them out on leave and forget about them. Sure this kid needs help. The public is aware of it, Mitchell is aware of it, it his employee and yet he does nothing to help his own people?

Lake County Sheriff Candidate Frank Rivero issued this statement today in response to the officer involved shooting reported on August 5, 2010 in several local papers.

“I have received a deluge of calls from concerned citizens relative to the recent officer involved shooting during an investigation of a pot grow by Bureau of Land Management agents and Lake County Sheriff’s deputies. Understandably, the community is concerned and eager to know the circumstances.

There are established procedures that must be followed any time there is an officer involved shooting and I understand an investigation of the facts is underway. The sooner those procedures are clearly explained to the public and the investigation is concluded, the better for all parties.

In the meantime, I urge respect and support for our men and women in uniform. Even for the strongest and bravest, it is a challenging process to endure, not only for the officers involved but also for their families, fellow officers, and friends.

The job of law enforcement is a difficult one, often done under extremely perilous circumstances. Especially at times like this, our officers, agents, and their families need our support and understanding. We must also show compassion for the loved ones of those who get caught up in criminal activity. To this end, my condolences go out to the loved ones of the individual who lost his life.”

As a deputy for over 20 years, I have found it not uncommon for a family to by god fearing honest people, but one member goes astray. Even Mitchell had problems with his pot smoking kid. A man is responsible for his actions. Try being a coroner and during your death notification when the family is crying and make your statement. You would be fired faster than the ink on the paper could dry.

Unfortunately they are under the command of Sheriff Rodney Mitchell. We believe the careers of these fine cops is in jeopardy and that their ability to grow, expand and further their efforts in a positive way with the community is currently adversely effected by the leadership or lack thereof of Rodney Mitchell. Recent events of the last two days gives renewed cause for great concern. The shooting and killing of a man in the Middletown area associated with a Marijuana grow and the details of this shooting along with the officer who shot the man are in question. Also this early morning a sheriff deputy was arrested for a DUI, this individual was arrested 2 months ago for he same offense. We question the help he was not given by his boss Rodney Mitchell.

We question not only this but the huge numbers of problem officers who frankly are attached at the hip to Rodney Mitchell. If these were the only issues, certainly we would see cause to withhold judgment. But this simply is not the case. Mr. Mitchell has shown himself to be a poor leader at best, seeming unable to control his people and their activities. He has turned a blind eye to the activities of his men and fails in every regard to be a strong and guiding light to the officers of the sheriffs department. From his own infidelities towards his wife who has MS, to the illegal use of public funds by some of his officers. From unfair and unbalanced disciplinary practices that has cost your county money to a decline in moral in the department that is terrible at best. We have come to the conclusion that Mr. Mitchell must go. We are asking you to vote for change and honesty and cast your vote for Frank Rivero in November.

But let the government do it, to the feds it is illegal to the state of California it is not. We are putting our local people at risk, when the Fed's should be taking care of it. Second, it is the method of going in that is in question, the killing of a person for several hundred pot plants is silly. You can pre-announce your arrival, there is no need for cops and robbers sneak attacks. And there is the question of that many swat guys and only one decides to shoot him. The danger so great that death was possible and only one guy sees it that way?? No one else shoot, so no one else thought there was a risk. You're right he is not on duty, but I'm not talking about Ski's decision, I'm talking about Mitchell's mind. Ski just killed a man and the next day he has Ski handing out shirts in Middletown (not far from the shooting)! Look, Mitchell should have Ski take some time off, at least a few days instead of a few hours. Ski will never back down from his an assignment no matter how he feels and Mitchell knew this. The shooting was near Middletown and Mitchell puts Ski on the main roadway in Middletown. I'm a former marine too and I believe that was the dumbest move I've ever seen. But what do you get when you have a man with no military experience running a paramilitary organization.

Please provide me with where you obtained that information. Your master Mitchell and the GOB's reviewed Rivero's shooting and found it within policy. Rivero got no discipline or criminal charges against him. The suspect jumped out a two story building, ran away and was found the next day by SWAT. Plenty of time to hide a gun.

Frank has no military experience whatsoever so I am not sure that is a fair statement. I'm not sure why it is such a big deal. Deputy Ski was off duty. If it is a justifiable shooting, which it sounds like, there is no wrongdoing. There is no reason to hide the deputy. After a shooting like that it is not good to leave them alone. Give em something to do. Have some compassion.

I think Rivero's press release was very genuine and well thought out. He is telling us to wiat for the investigation to be conducted and don't condemn someone before the facts are in. Like us he was not there and he can not say what actually took place. The worse thing anyone could do in Monday morning quarterback a police shooting where we were not there and it was not our life on the line. We were not the ones forced to make a split second life or death decisiuon. If we were would we make the correct decision.

Rivero asked us to consider the feelings of both those involved from LE and the suspect's family. Good work Rivero, this shows a realistic, compassionate and sensitive side which we have not seen in the LCSO brass in many years.

We'll see how this investigation turns out what what Mitchell does. Right away he went into his secrecy mode.

A point of information. A criminal investigation and an IA investigation is two totally different things and should not be conducted together or by the same people. The criminal investigation is to determione the facts of the incident, through interviews, witness statements and collection and preservation of evidence. Once completed this must be turned over to the DA for review to determine if there was any criminality involved and if so by who. They can determine if this was a legally justified officer involved shooting.

The IA investigation is to determine if there are any violations of department policy by anyone involved. Here they can determine if policy needs to be changed or training improved. It can also be used to discipline employees who have violated policy if appropriate. The sheriff has the final say in this case based on the reports and recommendations of his staff.

Professional LE agencies routinely place employees on paid administrative leave usually for one to two weeks to give them time to mellow out. During this time they are iterviewed by the departments Homicide Detectives who handle the criminal investigation. Those involved which is not just the shooter must be afforded their legal rights under the law and the peace officers bill of rights. The must be allowed to see both an attorney and their DSA representative to ensure their rights are not compromised.

Initially those involved are separated and their weapons are recovered as evidence. Representatives from the DA's office (an attorney and an investigator) plus someone from IA should be allowed to monitor the investigation. They do not take part in it and are not allowed access to the officers. This is to keep things on the up and up.

This is also The admin leave time is also when an inlightened department conducts a critical incident stress debriefing. This is done within 24 hours and not by a group of ministers. Lake Co. SO has no such process which has resulted in deputies becomming victims of PTSD which we've often seen in the past.

Bottom line in Mitchell has no clue how to investigate such a serious case properly. He's repeatedly shown that. I hope this time its not the case but I suspect we'll see the same old BS. Denial, smoke, cover up then in the end someone will bite the dust to save Comrad Mitchell.

Those of you who are SWAT team deputies and staunch supporters of Rodney should think long and hard about this. You too could bite the dust tomorrow and your Daddy will not think twice about it. We and that includes you need a new Sheriff who kn ows or is willing to learn how to run a professional agency. Rod is not the man.

It sounds like the LCSO Swat team which is aparently made up of Mitchell's GOB's (thugs) and supporters is haviong a problem with both competence and credibility. Actually that fits right in with their boss. I do hope they did the right thing in this case but by the time Mitchell gets through with his big spin the facts will be changed. His BB Sgt. Martin will stand up and look us in the eye to tell us what a pro Mitchell is but he too has lost any credibility.

The beat goes on in Lake County and the department anf their boss continue to screw up everything they touch then fall back and make things worse. We need to shake things up in that office and the first things is Mitchell along with everyone who has ignored or condoned his actions.

Concerning Deputy Bryan Smith: Someone is lying in sheriff Mitchell's organization and several people are involved. There is a cover-up going on and here are the facts of the situation as it currently stands. Sheriff Mitchell has been quoted in both the Record Bee and Lake County news as saying:“Bryan Smith was terminated on Wednesday the 4th prior to his 2nd DUI arrest. Oh really? Well let's talk about some facts. Bryan Smith was served termination papers that were “backdated” to the 3rd, Bryan was not served those papers until the 6th after his 2nd arrest. He was still employed when the 2nd arrest happened! Mitchell is trying a cover-up and he has just got caught in a lie. Mitchell is trying to make it appear that Smith was terminated prior to his second arrest, this is a flat out lie and a cover-up. You want facts: The notice of termination was served on Smith on the 6th by Cecil Brown and Brian Kenner they served Smith at his house. However the document despite being back dated by Mitchell was signed as the 6th by Smith when they went to his house. When was his IA interview: Smiths IA interview was done on the 29th of July. Inside sources indicated the blood tests from the first arrest were negative! Smith in the IA interview indicated exactly that and maintained his innocence with a lawyer at the IA hearing. Questions: Why did Smith not get a Skelly hearing in front of Mitchell which is standard protocol? His rights were violated according to Probar. This is a whitewash and he is being thrown to the streets to protect Mitchell. Where is the DSA in protecting one of it's own? Question: With an IA on the 29th has anyone after simply one interview where the individual maintains his innocence has the sheriff office moved so quickly to terminate an individual. The answer Never!! Yes suddenly we have backdated paperwork to the 3rd and his instant termination. Bye the way looks like this may be a title 24 violation, which is not pretty for Mitchell. The reason given on the paperwork for his termination states it was because of his first IA interview! Smith by law could not have been terminated on the 3rd without notification, he was employed up until he is notified and signs the paperwork! Mitchell has just lied to both the Record Bee and Lake County News. Also normally when a termination happens, the individual is left on Admin leave until the beginning of the new pay period which is the 20th of each month. Therefore Smith would have been terminated and then left on Admin leave till the 19th and that would be his last date of pay, it has always happened this way in Mitchell's department, but not on this occasion! If you buy one word of what Mitchell is putting down you are a fool

I am a former member of Mr. Smith's family and I know for a fact that he was let go from his position as deputy on Friday, August 6th when they came to his home and fired him. Chalk up another lie from the Sheriff's Department. Mr. Mitchell needs to leave Lake County asap, so Mr. Rivero can bring justice back to the Sheriff's office. Mr. Smith needed help, which he was never offered. There is much behind this story that the public will never know. Mr. Smith needs to be brought to justice - and he will be, but couldn't the Sheriff's office have intercepted and offered help when they saw something was wrong? I have no respect at all for Mr. Mitchell. He protects only himself at all costs.
 

Fact, Mitchell is supported by special interests, Lake Counties pseudo big shots, CCW permit holders who fear losing their guns and a few thugs maskerading as deputies who give law enforcement a bad name.

1.Of all the SWAT officers on the scene only one decided it was time to shoot the individual. By the way it was a very calculated head shot.

3.The shooter (ski) is the same individual who is quoted as “even if it is a Jose” all reported on channel 7 news reports.
4.On the day the shooting happened Mitchell has taken down all reference to the allegations concerning the racial issues with Ski and his rebuttals to the reports and the page now says it is under construction!! Just unusual timing?
5.The grow was known by everyone in the SO they have been working that site for years.
6.Also reported that sometimes SWAT members have camera's on their helmets, any video?

Concerning Deputy Bryan Smith: Someone is lying in sheriff Mitchell's organization and several people are involved. There is a cover-up going on and here are the facts of the situation as it currently stands. Sheriff Mitchell has been quoted in both the Record Bee and Lake County news as saying:“Bryan Smith was terminated on Wednesday the 4th prior to his 2nd DUI arrest. Oh really? Well let's talk about some facts. Bryan Smith was served termination papers that were “backdated” to the 3rd, Bryan was not served those papers until the 6th after his 2nd arrest. He was still employed when the 2nd arrest happened! Mitchell is trying a cover-up and he has just got caught in a lie. Mitchell is trying to make it appear that Smith was terminated prior to his second arrest, this is a flat out lie and a cover-up. You want facts: The notice of termination was served on Smith on the 6th by Cecil Brown and Brian Kenner they served Smith at his house. However the document despite being back dated by Mitchell was signed as the 6th by Smith when they went to his house. When was his IA interview: Smiths IA interview was done on the 29th of July. Inside sources indicated the blood tests from the first arrest were negative! Smith in the IA interview indicated exactly that and maintained his innocence with a lawyer at the IA hearing. Questions: Why did Smith not get a Skelly hearing in front of Mitchell which is standard protocol? His rights were violated according to Probar. This is a whitewash and he is being thrown to the streets to protect Mitchell. Where is the DSA in protecting one of it's own? Question: With an IA on the 29th has anyone after simply one interview where the individual maintains his innocence has the sheriff office moved so quickly to terminate an individual. The answer Never!! Yes suddenly we have backdated paperwork to the 3rd and his instant termination. Bye the way looks like this may be a title 24 violation, which is not pretty for Mitchell. The reason given on the paperwork for his termination states it was because of his first IA interview! Smith by law could not have been terminated on the 3rd without notification, he was employed up until he is notified and signs the paperwork! Mitchell has just lied to both the Record Bee and Lake County News. Also normally when a termination happens, the individual is left on Admin leave until the beginning of the new pay period which is the 20th of each month. Therefore Smith would have been terminated and then left on Admin leave till the 19th and that would be his last date of pay, it has always happened this way in Mitchell's department, but not on this occasion! If you buy one word of what Mitchell is putting down you are a fool
 

Remember this, a number of Lake Co. voters did vote for Rodney Mitchell. Not nearly enough to take it in the primary and Rivero did whip him soundly but its not over till the fat woman sings. Don't let up on him one bit because there may still be enough fools out there to allow him to slither back into office for another four years of lying, cheating, cover ups and lord knows what else that he has not yet been exposed doing.

Get out and tell everyone to vote for Rivero for change. If they voted for Mitchell or Baxter in the primary its OK to switch to Rivero and make sure we get professional law enforcement and no more BS. Mitchell has got to go and that department needs a flush.
 

Mitchell lies to the news media time and again and they still favor him. What's up there?

Mitchell lies to the media. He lies to his wife and family. He lied to the BOS and his deputies and supporters. He lies to the tax payers and the voters. What does that tell us? Mitchell is a liar. Is this the type of person we want as the chief law enforcement officer in our county? I don't.
 

I'll bet the day the election results are in and Mitchell figures out he is out he'll break down and cry like a baby. I just don't understand what happined. I'm the new and improved Rod, everyone loves me, I'm a crime fighter.
