Lake County Deputy Francisco Rivero, who is running for sheriff, thinks the internal affairs investigation against him for alleged assault is complete-clearing him; yet he said Thursday he has not received proper notification from the department saying so.
On March 27, two deputy sheriffs served Rivero with a notice of investigation for allegedly using excessive force, gender profiling and sexual battery on Rhonda Straub Rully while on a domestic violence call with Deputy Bill Djernes. ' I'm innocent of everything I've been accused of," Rivero said.
"About two weeks ago, I was called in for an interview on the investigation with a Napa County District Attorney investigator, Bill Jabin," Rivero said. He said, Rully's husband was interviewed and I have been cleared. He said my story was consistent with the husband's and Deputy Bill Djernes's. He said the two interviews were completed. He said the information derived from interviews was consistent with what I had said." Jabin said he couldn't give details on the interviews he conducted.
" I submitted a report to the Sheriff's Office in Lake County," Jabin said. "They need to make the determination if anything needs to be done in the case."
The Lake County Sheriff's Office would not give details on the investigation.
" The Sheriff's Department does not make public, any information relating to internal personnel matters," Capt. Jim Bauman of the LCSO said. "Peace officers have a due process rights and we are obliged to protect those rights."
Sheriff Rod Mitchell, who is running for re-election said, "It seems that Mr. Rivero is more available to the local press than his command-level officers. He was instructed as of yesterday to contact Capt. Brown regarding the matter at-hand. It remains the position of this department that the obedience to penal code and obedience to regulations requires that these matters are not discussed publicly.'

Now does this mean you have opened the comment site on your page. You dear friend are the one continuing to watch our site wouldn't you think. You have endorsed Mitchell, because you un=fairly attacked Rivero, and we proved it. That is the issue John and you know it, you would not be trying so much damage control if it wasn't true. Face it we had to expose you, you know it, it was the right thing to do for the citizens and for the necessary transparency. Now what about the questions John who was the audio played to? Garzoli gone and Perdock gone. Mitchell never took responsibility for any actions on his part. Mitchell’s poor management has left the largest black cloud in LCSO history. Mitchell never took responsibility for his actions in the Dinius case (not securing RIMS, hugging and consulting Perdock during the investigation and not taking a firm stance on Perdock at the start), not did he with Garzoli (did not review the DEA grant, knew Garzoli was flying the helicopter and gave false information to the BOS).

Now a new problem for Mitchell is coming forward. It seems former LCSO sergeant Jim Beland has filed papers in superior court to access all the deputies files to uncover Mitchell’s unfair discipline. When this hits the fan the people of this county might be lighting the torches for a lynch mob on Mitchell.
 

You think Garzoli was bad? He doesn't hold a candle to McMahon and his actions in LCSO. But Mitchell promoted him all the way to lieutenant. What a bunch of Keystone Cop managers.

When the Record Bee printed Garzoli's E mail they got the date wrong. BUT! they did print the whole E mail.
 

That date thing is still a big question, and it comes around the time that LCN had knowledge of the Garzoli Audio, that they kept promising the citizen they would investigate and never did. But the Garzoli e-mail came out, and many still do not buy the dates on the e-mails or the timelines.

552 that article was BEFORE the end of the law suit. You should read what you post. Rivero not only fought the SF Coroner's Office over a 15 year court battle, but won. A quote from that article stated "Rivero was awarded $116,040 in an initial jury verdict, but the city appealed and a new trial was ordered." That's right, they appealed and lost but it cost even more to the city which paid out more than one million dollars.

Our title of our Blog is not, "whining at Lovelace" so get a clue post some wonderful facts about how great Mitchell is, and get on the right thread. Wow, what a background. Well, apparently Baxter did it all. He's been there and done that, now, it's the time to stay retired. He looks like he's having a good time running for sheriff. After all, he is glib, and smiles a lot. But I don't trust him. There is no reason for a man that already has had a long career, and is, let's face it, a retiree trying for a last hurrah? he is just hurting the opportunity the citizens have to unseat Mitchell. That third hat in the ring could spread the vote, so no one gets a majority. Yes, Rivero has an ax to grind, because he saw from the inside the corruption at the lcso, and wants to clean it out. And the dirty tactic Mitchell used to smear his name before the election with a phony ia. I'd be fighting mad too. We need this fighter to win the election. If Baxter really wanted to clean-up the lcso, he would drop out, and back Rivero. If he doesn't, he is just a spoiler. It's like putting a shill in a card game to screw up the cards, so the casino comes out ahead.
On another note. I went to Rivero's web site, and found his calendar full up to election time. But, how will the public know about the meets, dinners and parades, if someone doesn't get the information out there? Just a concerned voter for Rivero!
 

well 856 you can attempt to diminish the tragedy of Lynn Thorton, but the point even beyond her tragic death is in fact the department as a whole, as this tragedy points out all the levels of corruption that has and does exist in the SO. You see you are right it is not just about Lynn's death it is about what the aftermath of that tragedy has showed us. The terrible cover-up the terrible mis-management of the investigation, the covering for Perdock, the whole nightmare after the crash is also what is being exposed. No one is going to let this rest until justice in the manner it should have originally been applied is served out in large portions to both Mitchell and Hopkins.

This is the Lovelace group, Finally we have the report of Garzoli's termination in the local Media. Now let's deal with the facts Liz left out of her report. As you will notice they used the Garzoli Insurance forum conversations(you know the ones we turned into Anita Grant and the board of supervisors, oh and guess what they used the Garzoli Audio from KGO that we informed Anita, and the BOS about, this was also the information we brought up to Hopkins on the last radio talk show, where we told Hopkins he better check with Anita and get going on that as part of the investigation of Garzoli. Oh let's see we are just beginning, we have been predicting the demise of Perdock and Garzoli for several months and got hammered by the corruption supporters, our quote "you will never see Garzoli and Perdock in a uniform again" Now you will notice that LCN did not give any credit to the Lovelace group for producing all the information they used to describe the reasons for his terminations. We presented this information several months ago, and have been hammering away on it since then. The Lovelace group is proud to be the sole entiity bringing this information to the investigation, and it being the contributing factors to his termination. We will post more this morning as there is more to this then meets the eye...Great job to those citizens investigating this evidence, we are proud to have been such an integral part of ensuring Garzoli was exposed.

Isn't that an interesting question Frank raises, they ask for him to disparage our very important Blog site, but don't ask Mitchell to disparage the nasty Racist Video's of crom 77...Interesting, this is the direct indicator of the Mitchell LE/Lcn connection.

It’s evident that Frank Rivero did not respond with “Silence”. Elizabeth is upset with the Lovelace group because she’s had a falling out with them. Perhaps she’s justified in that, perhaps not. But to blame Frank Rivero for their comments is equally as ridiculous as blaming Mitchell for every comment made by one of his supporters. It should be understood that Elizabeth has a long-standing relationship with the members of the Lovelace group while Frank Rivero had met only some of them in passing. The Lovelace confirmed that today in a posting on their blog where they said the following: “The Lovelace group has had a long and involved relationship with Lake Co. News since the launching of the Sheriff Mitchell Watch citizens Blog site. What Liz has chosen to omit from her opinion piece is this deep and involved connection.”

Sheriff Mitchell can lay asleep and wonder where his decision making skills went under the bus.

The poor slobs who lost their jobs maybe should never have been promoted. The Command and Control function in the Lake SO is in my humble opinion on par with Wally World.

Sad these guys get no pension until 50 and no health benefits, and nothing if fired and do not jump ship.

Blame the guy at the top Mitchell, and a sad DA Hopkins for not manning up and kicking but before the free slide into Bad Cop Port of Call Lakeport.
 

This is a forum for detailing the corruption in Rodney Mitchell's Lake County Sheriff's Department and Jon Hopkins' District Attorney's Office.

That statement is right at the top of the page, you may have missed it, fairly clear though. If you can't quite understand it, re-read and maybe it will come clear to you.
 

Mitchell promoted Perdock from sergeant all the way to Captain.
Mitchell promoted Garzoli from deputy all the way to Captain.
Mitchell promoted Cecil Brown from deputy all the way to Captain.
Mitchell promoted Morshed from deputy to sergeant.
Mitchell promoted Harvey from deputy to sergeant.

Is this all? We will soon find out when Beland's court action becomes public. I'm sure LCN, Record Bee and Channel 7 will be at the court clerks desk first thing Monday to get a copy of it. Mitchell should have never fired Beland and before the election we will hear more or Mitchell will say "it's a personal matter".
 

I think in the name of transparency LCN needs to admit they had a "long and involved" relationship with sheriff mitchell watch. It seems like that cat being out of the bag really surprises the corruption supporters, how about it Liz, John, you ready to man up and take your medicine, you were playing both sides of the fence and got caught by some folks that were just a little bit sharper and planned a little bit better, there is always as they say method in the madness. Sounds like a lot of people underestimated the Lovelace group, and from what I can tell they like being in that position, they remind me of the old detective show Columbo.

In the military, a captain takes responsibility for his ship. A general takes responsibility for his actions and a president take responsibility for his staff. I wonder why a LCSO Sheriff does not take responsibility for his staff and actions?

Remember when the Sheriff of Contra Costa was interviewed about his detectives failing to find a little girl imprisoned in the back of house for several years by a sex offender? That Sheriff stood up in front of the camera and took full responsibility. Since he did, nobody else criticized him. Instead when the people demanded answers from Parole, they made excuse after excuse. You can go anywhere in Contra Costa County, pick up a paper and see some type of comment against Parole. Reminds me of Mitchell.

Looks to us like Mr. Beland has saved the best for last. by design we suspect. Timing is everything, and now Mitchell has another item on his plate he has to deal with, and Mr. Beland has a lot of citizens in his beat that liked him alot, he would spend a lot of time talking with the public, watching the soccer games and talking with the immigrant workers who help on the vineyards and other AG jobs. Beland had a good following in his area, and as well was always going after the unfolding gang issue. We suspect those that worked with Beland and the citizens who support him are all Rivero voters now.

If you have put any thought to what I have said before.You would understand this local government is not about us the citizen but those that are to work for us the citizen. The Dinius case allowed all that can see past their noses to become aware. To lie and cover up for for employees was the way it was when I made my complaint to this local government. There was some that understood but found out there was no recourse with all the rules,regulations and laws to protect the bureaucrats so my complaints fell on deaf ears with no action to clean up the mess.Its a personnel matter and the dishonesty goes on. You are right there is more at stake here but leaving the status quo will not change it. I would rather put my faith in officer Rivero than Mitchell. I could only be wishing,hoping and praying about officer River but Mitchell has shown me what he would do so He is out. I'll pray to my God that I'm right with officer Rivero. What is your opinion of Mitchell using these last minute terminations to try and bolster his image(which is failing terribly)..Why should Hopkins and Mitchell not be thrown out on their collective ear for what they have done to this county in the past years? etc etc etc.
 

To give you an example of how leaders have to take responsibility for their own actions, I remember many many years ago when I was serving on board the USS Enterprise a carrier stationed out of Alameda. We were coming back into port from a Westpac cruise, and as you come under the Golden Gate bridge, the controls of the ship are handed over to the Port Pilot, to navigate the huge ship through the channels dug in the bay. Well the Pilot master grounded the Enterprise right in the mud. Not a thing the Navy likes to see happen to their vessels. Guess what happened that Captain of the Enterprise was relieved of his position as a military captain demoted and would never captain a ship in the navy again. He wasn't even in control of the ship the pilot master was, however it is his ship, his people on board and he is responsible as the leader. This is how the real world works in leadership positions, unless of course you are trying to slide by like Mitchell and Hopkins!!

Frank Rivero had an exellent turn out at his meet and greet at Konicti Vista Casino last night. The public sure has had enough of the way this County has been ran for the last 16 years. I dont think there was one person in the room who didnt have a valid question or concern. There were atendees from EVERY Town in this County. Frank took each question seriously, and responded truthful and accordingly.

Frank then pointed out former Sgt.Kip Ringen, and told the Audience that Kip Ringen decided to retire early after 27 years of dedicated service to the LCSO because he had enough of Mitchell's Crap. There was a standing ovation. Frank said its a loss to this County when great men like Ringen with so much experience that they could be mentoring the Rookies, have now decided it's a better life to be Fishing and riding his Motorcycle than playing Mitchell's games.

Then a Little Red Head Gal who is the Local Spokesperson for the Family of Lynn Thornton got up and spoke. Once again confirming John Thornton and Carol & Jeff Stambuk's backing of Rivero for Sheriff and Anderson for DA. She apparently attended the trial everyday and educated the audience of a few things (all in the transcripts)...one of the most apauling things was, that on Perdock's Blood Kit to the Department of Justice, HE WAS LISTED AS THE VICTIM! And the horrific treatment by Mitchell and Hopkin's to the Victim's Family. Then she went on to say, that she was just one of a handful of former Employee's of the LCSO (and the only female) who has the balls to speak out against Mitchell's Empire, along with Frank, Kip Ringen and Mike Morshed. Because as she put it, Mitchell's Nazi Regime always try's to intimidate "fired" employee's. She sure dosent mix words, and told us from the start she isnt very Politically Correct, just tells things as they are. She told us that just recently Mitchell, in a desperate attempt to make it look like he can contol his department has thrown 4 Deputy's under the bus (her words) She said 2 were more than deserved (Perdock and Garzoli) WE AGREE!! and two were total Bull Crap(Morshed & Wright). After the Debate I found out who her father was...He was my horseshoer. Oh Boy, her dad was sure someone I would never have wanted on my bad side. It was rather sureal to see this well dressed gal, talking just like her dad, but with a little more polish. Im guessing thats just because she was in public! (By the way, this family was a very hardworking, and very well respected in the Horse Community in several counties, may her dad RIP)

I was already leaning towards Rivero, but after last night I will do my part in helping RIVERO FOR SHERIFF.

In closing, I wish to Thank the Founders of this Blog, The Former Employee's of the LCSO who stand up for what is right, Frank for taking Mitchell on, and for the Honest Hardworking Men and Women in the Department for your service. It sounds just like there just is a "Dirty Dozen" up on Martin Road that have taken advantage of the Badge for way too long.

Perdock NEVER identified himself as chief deputy nor did any of the deputies that were at the scene identify perdock as a deputy instead of take names and numbers they proceeded to take witness' statements and in every statement every witness states they saw a WELL LIT speed boat and they all stated that they saw The WELL LIT POWER BOAT hit an UNLIT OBJECT . Every witness then testified they did not see the sailboat prior to the accident . Nine witness' who saw the lights on the sailboats lights in were not included in the list of witness collected by the sheriffs office . Sgt Slaybaugh of Scso has twice testified that his investigation was based solely on the testimony of Russell Perdock and That he was ordered not to contact any other witnesses . Mitchell claims his investigation was by the book yet twelve jurors would have convicted perdick but they were there to judge an inocent man . Vote for justice vote Rivero and yes I am a witness to this accident and I know the truth .

Garzoli had no vote because management can not vote.
Beland had no vote because he was not a member of the department, had been fired one year earlier.

I just happen to be a childhood family friend with a Former DA Investigator who was working for the County of Lake at the time at the Boating Accident. Yes, he also did testify at the Trial. After he testified, I walked outside and talked to him. He knew things werent on the up and up when Perdick walked into his Office and TOLD HIM WHAT TO PUT IN HIS REPORT! That's when he decided it was time to get the hell out of Lake County and go work for another Agency that would not have such un-ethical crap going on. I have been tracking some interesting stats over the past month or so, and the numbers are showing me that since LCN has come under scrutiny for there bias reporting and for their bias attacks on everyone but Mitchell, and overall during the course of these elections they have lost readership consistently. Now this is to be expected as their opinion piece for example was torn to pieces by the Lovelace group, and their association with the Lovelace group has been shown clearly, yet they wanted to claim differently. That is in the near term even in the long term since the elections really started they have lost significant ground. Again to be expected, given the negative press on SA, and the hammering taken on this site as well as the bogus attempts to attack Rivero, it seems that all of it has taken a great toll. interesting stuff, just passing it along.

Maybe a day late, but not a dollar short. Hoppy applied to be DA in Santa Cruz (his application can be found on line in pdf form if you search for it). He didn't get the job, and was royally po'd. So Lake County was a safe haven, having burned his bridges in Santa Cruz. Wife ran for Supervisor down there, didn't get elected, then Jon tries to get appointed DA, and didn't. Time to get out of Dodge. Hello, Lake County. Unfortunately, no one ran against him in 2006, but we really didn't know what he was made of then, as he had no local track record other than as chief deputy DA. So when Luck announced he was retiring, (and Hopkins also applied for a judge job that went to Martin) DA looked like a safe place to be. Like it or not, that's the story, and you can confirm all of this with a little Google work...

It is typical of this group, this elitist network working with the Mitchell regime. And it is sad, this county is falling apart, and those that are responsible are asking for 4 more years! This is day 137 of Mitchell's failure to resolve his politically motivated I.A. against Francisco Rivero. Rodney Mitchell finally released documentation indicating that the date on the complaint was January 7th, not January 15th as was previously reported. Although Rivero provided a statement from Rully's husband stating she was a liar, Mitchell still refuses to clear Rivero.

When asked about what he thought of what is happening in Lake County he started laughing and rolled his eyes and said if I was Mitchell I would have called Chp and put as much distance as possible from the investigation . Hey why are we leaving Victoria Brandon's blog in TWICE..for Baxter. She talks long and says nothing. Your argument against Rivero doesn't carry water. Tsk tsk, he is an angry man, not like easy going Baxter? that's what we need, an old guy who has had a good life and has retired, then decides to run for sheriff in a county that he has only been in for a short time...with no association with the years of skulduggery in the sheriff and DA departments, among others. Rivero is there, and has experience of the underhanded workings, the gob's, and the bias against minorities, etc. He is putting his and his families lives on the line to serve Lake County, and bring true safety to it's citizens. "his inability to follow orders"? Right, shut him up while a phony charge is made against him, and Mitchell fails to settle the matter quickly, as he is supposed to. I think that Mitchell is afraid of him. Good, he needs to be, because Rivero is the only viable candidate that will make the department one that people will once again trust and be proud of...because that's what he will do. He has a dream, and it is for all of us in Lake County. We need him. Baxter has had his time, and has no ax to grind for the people. Sure, he could probably run the department, but I'll bet the same old crew will be there, and any hopes to make the changes that are needed will just go away....again. Since you are for him, of course you think he will have no effect on the other candidates, since a three way race will probably turn into a runoff in November. Well, we Rivero supporters know that Baxter will just take needed votes from Rivero. I think that you are afraid that if Baxter wasn't running, that Rivero would have a good chance of beating Mitchell in June. Anyway, I believe that Lovelace has already admonished that this is not a blog for Baxter, but is for Rivero, and the removal of Mitchell. So go away, and start your own blog.

1.) The Beland information is stunning and a huge blow to Mitchell, we are stunned by the detail and significant of the allegations brought against Mitchell and the County. This is huge ladies and gentlemen. What this directly and without doubt shows is the Corrupt Mitchell regime and how he mis-managed his people, how unfair his practices were and how he only brings to light those situations that he wants to in order to attack certain people. This is going to be highly costly to the county, and for how long did we tell the BOS that you must ask him to step down, as a show of common sense and decency to the county and to the good men and women working in the department. Now look at what the sit on your thumbs BOS members have allowed to happen right under their nose, and we have been telling them this for months and months. If they had done what we told them they would have ended Mitchells attmept to keep his position. What a shame they have no sense of the destruction they are contributing to in our county.

The Beland claim is directly centered around "unfair discipline practices" and will cost the county plenty, Mitchell cannot overcome this and now he cannot hide from the truth. Great job Mr. Beland!!!!!

She works for the Sierra club, which is all fine and well, but hey Victoria where the hell were you when the citizens were fighting for their county the past 4 years, when have you spoken up against Mitchell, never Victoria, you would have thought you would have learned something from Phil Murphy, at least he put out an effort. You have concentrated your time on the environmental issues in the county which is fine and well but you have never stepped up on the corruption or those issues. Now out of now where you want people to give a crap about what you say in the election!! Please in the political scheme of things you are a no-body and your opinion is far less then valid to the citizens who care. You should have kept your mouth shut like it always has been and not acted like anyone should listen to you. You keep doing your environmental gig, we will handle the corruption.
 

Don't worry about Victoria, she is entitled to her opinion even if we disagree with it. If you read closely between the words, you will notice the article is a big slam on Mitchell. Victoria will most likely read the comments to her article and might reconsider. Either way, it is a slam on Mitchell more than Rivero. Baxter has done nothing wrong and maybe that is why we like Rivero the most. We want an angry person because we are angry about Mitchell and the GOB's. It is the people that are angry and Rivero is not only expressing the will of the people but his own anger. Just simply and respectfully state your case to Victoria.

She has had plenty of opportunity to speak up in the past, because the bottom line is you save the environment all day long in this county, but if the county dies its own death due to the corruption and lack of tourism and the terrible name it has gotten for itself world wide it really doesn't amount to a hill of beans, but we do agree that she is 50% there by disavowing Mitchell. As we have said over and over there is more to come, and it is going to cost the county dearly, we said this 10 months ago, we asked all of you to do the right thing, and you would not. We told you, in Rob Brown's words "This is going to leave a mark" and in fact this is. How much money could all of you have saved the county by a simple non-political statement of no confidence, and simply stepping up to the plate and facing Rod Mitchell for what he has done to this county. This is done through-out the political arena of our country, and very common practice when an elected official has gone to far. But none of you, not a single one had the insight and guts to do it.

If you had done this 10 months ago, do you realize the Beland case may not have come to bear. If only he and others had known that the cards were on the table and that people who cared were running the local government, but we supect he did not have that confidence, and you 5 are to blame for this perception, and the subsequent issuing of this suit and others to come. You cannot seem to see the forest but for the trees, and it is a sad display of lack of leadership on your parts.

That was uncalled for. Mike is a good Dad and never neglects his daughter. I've seen them out and about plenty of times. Although Mike was fired from LCSO, that doesn't make him a bad father. I've known Mike a long time and he never mistreated, struck or said foul words to his daughter.

A complete and in-depth investigation concerning such allegations with exacting detail and truth would have to be present to leave such comments. There is to much potential for undue harm to the children. The Beland claim is huge, just read through the post. If we do not see this in each of the media sites within the next two days, then we have a real issue with a pure fascist news system in our county. We all have the information, and both LCN and the Record Bee do as well. My my, this should spell the end of Mitchell, if a single person can cast a vote for Mitchell at this point, then their ignorance is beyond belief!!!! Mitchell used his name on the calccw as he was campaigning for himself, his write up was as if he was a God, what we indicated was that everyone else on the blog is anonymous and as we posted some of the names and tenure of those folks gives blogs a really bad name. This case by Beland, is huge, I am not sure if all of you realize what this says. It says Mitchells department is in total and complete chaos. That underneath the surface things have gone terribly wrong. Look at the numbers the allegations, the patterns, this is going to make news, across the board, both LCN and RB will run this, they cannot black this out. This is so bad Mitchell stop his election bid and step aside. However only a man who can see what and who he really is would do so, and Mitchell is far from that high level. What you see hear is beyond statistically explainable, is beyond defensible and at the brink of illegal.

This 9 page document can be gotten by anyone at the court house, this information which is an accounting of the behavior of a great deal of SO's in the system, ruining it for the decent cops.

This campaign material should be used to demonstrate to the citizens what they are dealing with in Mitchell, there can be no better evidence then this.
