Hate to say it but Rob Brown is in the news big time again. There will be a report posted on the Blog this afternoon, concerning an issue Brown has been trying to keep off the BOS agenda,. You may have noticed there is an agenda item concerning the septic systems in the Rivera complex. There is much more to the story and Brown is involved in what may be a cover-up and desire to keep it off the agenda, there have also been reported threats against people trying to voice their concerns about raw sewage flowing on some of the property. Details will be posted later today.

Part one:

Thank you for the use of this site. Here is some of the information on the message earlier today. There is a very serious problem happening in the Rivera housing complex. This problem has been “percolating” for several years now, and is very complicated, but some of the main points can be made without taking to much space.

There is a dangerous and wide spread septic systems problem in the Rivera. There are currently many homeowners who have raw sewage on their property. There is apparently much blame to go around. Recently I was told that it appeared to this individual that Rob Brown might have been fighting against this coming up as an agenda item at BOS meetings for quite a while. Another living in the area, said it was his opinion that there may be a cover-up going on.

There is a letter that is available which I hope to get a copy of from both state and local inspectors dated in 1991 which went to the county stating the substrate of the Rivera's consisting mostly of rock and heavy red clay is not suitable for housing. That the heavy red clay rock combination in many areas cannot percolate efficiently enough to warrant multiple family housing. As we know this recommendation was not followed. Along those lines there is potential litigation against the county happening. A Third homeowner has said their opinion is that during the course of Rob Browns tenure as supervisor he may have “assisted” in “bypassing” certain guidelines and getting approvals against recommendations of building houses on certain sites.

There have been many attempts by homeowners to get this on the BOS agenda in the public forum, it is not hard to imagine why the effected homeowners would want to pursue that approach. Late last week, phone calls are alleged to have been made to Anita Grant and Mr. Cox concerning this matter and asked that it be on the BOS agenda, it is as you see on the agenda for this week. Was this the only way to bypass Brown's reported efforts to stall this out? An individual living in the Rivera has written a letter to a nationally known Watch Group that deals with these type of systems, which are described as basic multi-flow systems for assistance. Also one of the manufactures of a homeowners septic system, of this nature, told the homeowners that if they keep quiet the company will replace their system. There is a reported You Tube Video showing the raw sewage in some of the peoples back yards, I have not looked for the video. If someone knows where that video is and can post that please do. I do not know how long ago it was.

As of this morning a couple homeowners have suddenly started to back away from the BOS meeting and no one is reported as to why this is. Something has gotten them scared to come forward.

Another major part of this problem is who gave or allowed approval for 4 bedroom with only 2 and 3 bedroom capacity septic systems. It sounds as if there are nearly 100 houses in the Rivera with this condition. Some people have their views and who was involved in this.

Further more it is reported some of these systems do not have “heavy” waste first stage reservoirs. If that were true, it would be like a car without tires literally. There is more concerning Brown and this whole situation, but this is long enough. Anyone who has any information on this situation please post it, whatever it is. Thanks.
 

I know one big problem with the Rivera's and that is the homeowners association, now there is a bunch of no load crooks. The majority are from the old GOB network, remember a lot of deputies from the Mitchell days bought in the Rivera, they have a lot of constant scams going on and cannot be trusted any further then you can throw them. I recall an instance at my parents house not that long ago, when the septic began to malfunction for some reason. They called the owners who blew them off for about a week. They called the health department, this was in Southern California, and reported the sewage in their back yard. They were out that day, and hammered the owners, made them clear 10 inches of dirt off the top, disinfect with bleach solution, dispose of the waste they took out hit them with a fine, and made them replace the system. This is no small deal, this is dysentery, this is bacteria, this is very dangerous. Taking six vans of people to the top of Mount Konocti, the Commission launched a special event with wine tasting and appetizers at an elevation of about 4,300 feet on the warm Saturday evening of Aug. 27.


Approximately 90 people attended what is believed to be the first dinner and wine tasting event done on Mount Konocti, Commission President Shannon Gunier reported.

Several Kelseyville teachers have made contact with the Lovelace group. It seems they are up in arms about the way McQueen is running the school district. They say that he doesn't know what he is doing. The first year and a half he was directed by his predecessor John Beary. And now without the help of his inherited secretary, he would not survive. He is her puppet.
Normally the school keeps 3% of their funds in reserve. This year they want to keep 18% in reserve at the same time they are asking the teachers to take a 18% pay cut. When McQueen came into office the first thing he did was give himself a pay raise and now he wants another one. There is no Librarian, the janitor staff is limited, and yet there are no cuts to the sports programs. The teachers say that the wrestling scandal involving Rob Brown is typical of what goes on in the district. They say that many times they tell the coaches that a student doesn't have a high enough GPA to play sports but the coaches play them anyway. Their complaints fall on deaf ears.
And while the school goes broke, the School Board voted themselves lifetime benefits if you serve just four years on the School Board.
They had several choice words to say about Principal Cockerton also, however we will not print them here.
Expect more picket lines and maybe a strike, they said they have had enough.

Trouble is brewing for Rob, the majority of teachers and school employees want nothing to do with him. They believe the principle is in bed with Brown, and Brown has taken advantage of the kids the school district and is playing the principle hard. They are pissed off big time.
 

All that is needed is for one teacher to come out on the report card scandal. Someone must be a witness to that cover up? They could get rid of Brown, Cockerton and McQueen in one fell swoop.

Iraq War Veteran and Wife On Crusade To Correct Septic Problems with New Homes in the Clear----

David Bischel and his wife Gale met Feb 11th with neighbors President Walter Zuecher of Clearlake Rivera Community Assoc and members of the press to share problems they have been experiencing with aerobic systems, which have been overflowing in back yards since 2005.

The Bischells have complained to County Environmental Health personnel, the EPA, the Nation Septic Assoc., the company that made the systems, and finally made it onto the agenda of the Lake County Supervisors, according to Gale. Because of claims for damages, however, their particular agenda item may need to be discussed in closed session.
The family must use a porta-potty that they have installed in their driveway.! The family and others at the meeting had videos of the circular lids with brown liquid coming out onto the ground.
According to the Bischels, a certified service provider, Chris Lawson, who worked for Eagle Maintenance solved the problems by taking out the alarms and dumping the overflowing raw sewage in the woods behind the houses where the problems exist. According to those at the meeting Saturday, Feb 11th this stopped when Lawson was prosecuted.
Dave Bischel said he understands there are 1 0 0 homes built in the Rivera that use these aerobic systems. He stated, "There is raw sewage leaking all over the place!"
According to documents the Bischels have collected and saved, in 1991 a statement was sent to developers saying the property was not buildable because there was no land that perked, that is, would be able to handle a traditional septic system. Those who built these houses failed to install a "trash tank" that would have solved some of the problems.

Affected members of the Clear lake Rivera Community may lodge a complaint against Consolidated Treatment Systems, Inc.

The County of Lake Did respond to
issues raise by Rivera Community members regarding overflow from septic systems (how many complaints?)
In June 2010 the Director of County of Lake, Environmental Health, sent a formal Complaint to Consolidate Treatment Systems, Inc., the company that installed the septic systems almost 10 years ago.
The letters author wrote after inspection of some half-a dozen systems, the group of investigators argued that the septic system's problems were not due to "Mutlt-Flo performance." And, since all installed systems exceeded the manufacturer's two-year warranty, the company was "not in violation of ANSI?NSF Standard 40 or international policies."

The County waits 5 years to write a letter to the Septic company.
These homeowners have suffered with septic problems for almost 6 years and the County is only addressing it today? And Brown just heard about it, now I've heard everything.

An old problem, those who built on unbuildable land and did so knowing all about it, then sold it to those who had no idea.
 

Word was that land in the Clearlake Rivera didn't perk-so how did those tests get passed?
 

So many questions in regards to post 725, we hope everyone who has any information will contact Consumer Affairs and other agencies. It is hard to imagine that Mr. Brown has not been totally aware of this situation in his district for many many years. I would have hoped that a great deal of his time and effort would have been put forth in this situation, but it appears he has held a blind eye to the environmental destruction and the impact on the community. I find this totally unacceptable.

"Eagle Plumbing + Mechancial" in Kelseyville is Active and the owner is a Dennis Lawson 1984-3/31/2012.
# 453806 shows there are 2 complaints filed under Eagle Plumbing, there is a bond for 12,500.
I didn't see any "Chris" Lawson.
 

The septic system issue could only be put on the BOS agenda in general terms because there was a pending lawsuit. It was Rob who put it on the agenda.
 

Wouldn't you know it. Dennis Lawson, who is in the septic business, is Rob Brown's neighbor. He is also the neighbor whose water was being "stolen" to water Rob Brown's 5,000 Marijuana plants.
 

Neil Thompson was the soils engineer for all of Lawson's septic systems. His ex wife is Pam, who is a engineer for the County. Neil moved away about 10 or 12 years ago. I believe Neil was also a tax consultant. I think he moved to Monterey.

Thanks to Mr. Bischel for his efforts and tireless work on this issue, the information which we received and posted all last week was critical to pushing this agenda forward, we thank him for getting this into our hands and for fighting the good fight for so long. An amazing study authored by professors D. Mark Anderson (University of Montana) and Daniel Rees (University of Colorado) shows that traffic deaths have been reduced in states where medical marijuana is legalized.

According to their findings, the use of medical marijuana has caused traffic related fatalities to fall by nearly nine percent in states that have legalized medical marijuana (via The Truth About Cars).

The study notes that this is equal to the effect raising the drinking age to 21 had on reducing traffic fatalities.

While medical marijuana advocates will politely ask them to stop talking whenever the subject arises, there are many cannabis users who will claim that the task of operating a motor vehicle is safer when the driver is a bit stoned.

Turns out that researchers crunching traffic data from 13 states -- including car- and cannabis-crazy California -- arrived at a similar conclusion, only with an extra hitch: Drivers in states with medical marijuana laws are not only safer, they're more sober.

A 9 percent drop in traffic fatalities and a 5 percent drop in beer sales were observed in states where cannabis is legal, according to a study conducted by economics professors at the University of Colorado-Denver and Montana State University.

Something to consider: Traffic deaths are the leading cause of death among Americans ages five to 34, and as MADD reminds us, drinking-and-driving-related fatalities affect even the sober. So medical marijuana makes the roads safer for everyone.

The study is believed to be the first examination of the relationship between traffic deaths and legalized marijuana, according to study's authors, Daniel Rees, professor of economics at the University of Colorado Denver, and D. Mark Anderson, professor of economics at Montana State University. That in itself shocked the study's authors.

"We were astounded by how little is known about the effects of legalizing medical marijuana," Rees said. "Although we make no policy recommendations, it certainly appears as though medical marijuana laws are making our highways safer."

The study by no means condones the one-hand-blunt-rolling method performed while changing lanes. Rather, it observes that such behavior is unlikely: Drivers who use alcohol are more likely to take risks, while drivers using marijuana avoid risks.

In fact, they might avoid driving altogether. Most medical marijuana is consumed at home, while alcohol is consumed at bars and restaurants, according to the study.

There's also a correlation between beer sales and medical marijuana laws: 20-to-29-year-olds buy less beer when they live in states with legal cannabis, according to figures provided by the Beer Institute. That makes the alcohol industry's opposition to Proposition 19 last year a little less mysterious. Less alcohol on the roads means less danger on the roads, hence the 9 percent drop in fatalities.

The study also looks at the oft-repeated claims of marijuana prohibition supporters that legal pot causes an increase in criminal activity (which was always dubious) and that medical marijuana leads to increased use among minors. The authors concluded that "no evidence to support [either] hypothesis" could be found.

The government takes your money to oversee that those that do the work,it is done correctly. The stonewalling will start from those that work for the system. The board of supervisors will do all to keep it the citizens problem.This dishonesty has been going on for a long time.

This is the Lovelace group: It is our firm belief that the rumors that have been going around the county that Rob may be starting to go over the edge are at the very least starting to be confirmed in this round robin of useless time being spent by Mr. Brown in his initial correspondence to the sheriff. It is interesting to note several things in this exchange.
Rob Brown just spent more taxpayer dollars in writing and sending just the initial e-mail then the 10 seconds it took to post the sheriffs overview to the public on the accident that happened. It was proper as the sheriff pointed out to inform the public of exactly what happened. Rob is only upset because it is exactly what happened and he was hoping for more actual injuries and that this would be a big deal, which as everyone knows it is not and is water under the bridge of a small and minor incident. The sheriff was correct in informing the public, Rob should learn a lesson from this.

In e-mail number 3 you will see that Rob has agreed with the sheriff that it is a responsibility to keep the taxpayers informed even though in the original e-mail he was trying to say that it shouldn't be done. But the funniest part of the “taxpayer” comment of Rob's is that he is the one who tried to get away without paying taxes and has a $50,000 tax lien against him!!! Rob please pay your taxes, don't get caught illegally trying to avoid them, and then try to hammer on someone concerning you being a taxpayer. When Rob does seek help, no he won't pay for it, we the citizens will as it will be done by his health insurance we provide, more on that in a moment.
 

Now here is the second funniest part of Rob's growing delusion and paranoia:

As you again see in e-Mail number 3 Rob has taken quite an issue with being called out on the extensive amount of time he spends at K-Ville lumber and the fact that the Lovelace group has people reporting to them anytime Rob enters the store. When he is on the taxpayers dime We had heard that Rob is really starting to get angry and upset and paranoid that he is under such scrutiny from the citizens. Secondarily to see Rob trying to name members of the Lovelace group as individuals, and still to this day not realizing what a loose knit and participative format we run with 40 to 60 people being Lovelace and having access to the site along with investigators and others giving us information and watching Mr. Brown is fantastic. Several of us having talked to a great number of other members have been told that no one has talked directly to the sheriff in over 3 months!!!! This is the beauty of this model, this is the beauty of letting people think they know who is posting and when. Despite that fact that it would be impossible for anyone or even two people to man the site almost 24-7, that hint does not seem to sink it. Again it appears Rob's paranoia is starting to really effect him.

As the sheriff so correctly pointed out to Brown he (brown) does not like the model of transparency and openness that is happening in the county. The sheriff said to Brown: “The days of keeping the Lake County public uninformed of what their elected officials are up to are over.  Don’t you think it is high time you put these archaic tactics to rest?” perfect answer.

Now look closely at who Rob Brown has cc'd in his address's. Does he not realize that all the newspapers and news outlets he has sent this to are laughing their ass off at this childish little man, Also look up some of the address's, you will be surprised to see who he has sent this stuff to.
 

Final post:

To say the least the last response by the Sheriff is one of the funnier quotes that has ever been on the Blog. Many of us fell off our chairs on that one. Overall a complete pounding of Rob Brown and well said by the sheriff. It is our belief that based on this overtly biased rant by Brown should preclude him from any participation in any activity or decisions made by the BOS concerning any matter of the sheriffs. Brown should be removed from any input in any manner concerning the matters of the sheriffs department or its operation.

On a final serious note, it is ironic or perhaps very telling that in his last reply Mr. Brown has agreed he needs to seek help. We know that this is a tongue in cheek comment or in Brown's case a foot in mouth comment, or could it be that in reality Brown knows he is going over the edge? We pose this question to the citizens as a whole. In closing we think the public as a whole should be very concerned about the condition of Mr. Brown, remember reports are Mr. Brown carries a gun with him strapped to his ankle apparently. Far less serious things have happened to people who then have carried out terrible acts of violence against others when they go over the edge while under pressure and while their past actions and issues are being exposed. It may in fact be time for Mr. Brown to either seek help or at minimum step down or both. We hope that he can gather himself and control himself, but serious doubts although just peoples opinion of their observations of him are being raised now as to his mental state.

I haven't heard of any drug testing in the sheriff's department since Frank got elected. He made a point of doing regular testing if he were elected. That was in response to Mitchell's neglect to do so during his tenure. I know of some deputies using drugs, including steroids for years, and getting away with it. Anyone have any information?
 

They history of drug use, illegal confiscation, heavy steroid use by the deputies of the old Mitchell group, is well documented. Some of the stories are funny as hell, as when the wife swapping was going on the banter amongst the "gals" was the major shrinkage these deputies were suffering!! I refer to the Gemini group, some of the same ones that have smoked pot at Doug Rhodes house on weekends. But anyway, the process of getting drug testing done has to be approved by the union and a whole host of other legal goo gaa to get it all approved. Neil Thompson was the soils engineer for all of the septic systems that Dennis Lawson installed. Dennis is Rob's neighbor and supplier of water to Rob's crop.

Rob took his backhoe in for repair and was told the parts were going to cost several thousand dollars. He said he didn't want to put any money in it, he just wanted to take it to auction and sell it. They told him that the wheels were ready to fall off and it could kill someone. He said he didn't care, he was tacking it to auction to sell.
 

If the backhoe is that bad it will be obvious to whoever buys it as well. Equipment is sold "as is" all the time.

Arroyo Grande detectives found that amended tax returns, as well as a request for a refund and a change of address, had been filed without the resident’s knowledge.
The federal indictment states that Thomsen obtained names and social security numbers of several of his former clients and clients of his former employers to file false tax returns in 2009 to obtain tax refunds.

More interesting information to come on the Blog, and there has been a huge appelate court decision that came down today in California. Stand by for that, as well as more information coming in on the Brown storage shed/proper public wrestling facility built to those spec's for a highschool, permitted as such signed off as such, etc. And what are the questions that need to be answered in this regard.

Here is the latest ideas being passed around, one individual who was talked to thought this was potentially a very serious situation for Rob Brown specifically. It is his very adamant statement that this was a real issue, and a lot of things were done wrong. From permitting to what happened after inspections by the state were completed? By what description was the building presented to authorities and permitting agencies? Is the building fully qualified to have the kids in it. Is it earthquake standards as required? From the perspective of safety of the kids and others, this could be a real issue. There are a number of people looking into it, and trying to find the correct paths to uncover the documentation etc of what if anything actually happened. Something is wrong it seems, but to what degree is the question.

THIS IS THE BIGGIE FOR THE DAY:

The California Court of Appeals has ruled that California cities cannot ban medical marijuana dispensaries so long as they cultivate cannabis at the same location. The 48-page ruling came in the case of the City of Lake Forest vs. Evergreen Holistic Collective, one of several collectives the city shut down for violating its ban on pot clubs. Because state law allows for marijuana collectives to cultivate and distribute cannabis to members, the court stated, "a local government cannot ban as a nuisance exactly [original emphasis] what the Legislature contemplated would occur at cooperative and collective medical marijuana cultivation sites."

One of the lawyers attached to the case is Matthew Pappas, whose separate lawsuit against the city of Long Beach resulted in a ruling last year that struck down large portions of the city's controversial ordinance requiring collectives to apply for expensive permits that also required them to grow onsite, and which many observers, including the city itself, has interpreted to mean that California cities cannot regulate marijuana clubs at all.

It is all over the Internet, many are indicating they are starting the process of re-opening their dispensaries in Lake County. This is huge victory, but also throws everything into confusion. It could in some ways make the past battle over MJ in our county a moot point. The state is also, and keep this in mind, throwing a shot at the feds. This decision pits the state of California against the Feds and Holder. Will a battle be waged and in what way? Will the feeds walk away, or will they attack. These are valid questions from both sides of the fence. More to come.

Here are other portions of today's ruling on dispensaries. Take careful note of the last one as it indicates that the dispensary only has to have those of the collective grow the product not necessarily on site.

# The Second Appellate District court (similarly to the Fourth Appellate District court in Lake Forrest) discussed the interpretation of the what it means to "collectively or cooperative" cultivate medical marijuana. The court relied on the interpretation of other types of cooperatives such as consumer cooperatives and grocery cooperatives. It would be unfair to require members of a medical marijuana cooperative to participate in a different way than members of other cooperatives whose only participation might be to shop at the cooperative.
# Pursuant to the Attorney General's Guidelines from 2008, "collectives and cooperatives may cultivate and transport marijuana in aggregate amounts tied to its membership numbers." And that nothing on the face of Health and Safety Code Section 11362.775 requires a specified number of members to be involved in the cultivation efforts.
# Colvin clearly determined that "collective cultivation" does not imply "local" cultivation but only requires that all cultivation must be done by members of the collective or cooperative.

In a collective effort that will not stop regardless of campaigns outcomes of races or resistance we will force Brown to deal with the truth and reality of the will of the citizens.

Want to put out a big thanks to Tom Carter, who as always is supporting his community and is helping the FFA (Future Farmers of America) to build their new barn. Thank you so much for your time and help. The AG teacher Erica went to work and got the approvals and grant monies for the project, and the kids are very excited, and several of them told the teacher that she should contact Tom because they know he will help, he always has. She did and the project is underway. Truly good people are hard to find, this community and this county are fortunate to have those like Tom involved and engaged with the kids.
