I think it's important to know if Barker and League live in our county because if they don't why would they take it upon themselves while in another state to check our Rivero's background, why would they care? What is the benifit to them? Why did the story change from Rod in the debate saying he "sent 2 people to florida" to now all 3 of them saying they just happened to be there on "another case". Riiiigggghhttt, like anyone believes that line of crap. I too wonder did these 2 leave LCSO for the reason of lying? GOB system at it's finest alive and well in Rodney's world.

Post on 10-2: "Doug Rhodes and Rod Mitchell have climed in bed together and seem to be practicing similar campaign tactics. Do both now employ Mr. Joe Ford as their campaign dirty trickster. It seems Rhodes lasted out at Anderson and made up a story about his not having a teaching credential which Anderson said he had. Anderson promised to produce it at the next debate and demanded Rhodes give a public appology.

"Sure enough the next day Anderson produced a valid documentation leaving Rhodes with egg on his face again. Again Rhodes ended up looking like Mitchell and getting caught in another lie."

I don't know what debate you were at, but Rhodes made it quite clear that Don did not and does not possess a teaching credential. He has an instructor credential for community college classes. A teaching credential requires a couple years of college beyond a degree in teacher training, followed by testing. In fact, you can't even get a valid credential until you've taught for two years, when the credential becomes truly effective. Don has a certificate given for vocational instruction in law and law enforcement at a community college or adult classes. It required no teacher training, or testing, and were handed out rather easily until 1990, when they stopped issuing them at all. Now if you want to instruct at a community college, they just determine if you have "minimum qualifications" and you are permitted to instruct. Don continues to believe he has a teaching credential, which even the paper ha has does not say. Rhodes apologized for not being more specific in his words and upsetting Don and his supporters. He didn't apologize for being wrong, because he wasn't. Don keeps saying he's a good listener, but apparently only if he hears what he wants to hear, while he continues to believe what he wants to believe regardless of the facts. Insisting that he has a teaching credential when he does not is a disservice to all the men and women out there who really do have teaching credentials, and is just another example of Anderson inflating his experience and qualifications.
 

I don't answer questions from anonymous people, especially about my votes. I did have someone ask me a question this morning that I will answer though...since I was a juror in the Dinius trial I am qualified. The question was whether blood tests were done immediately following the boat incident, as this person had been told they were. They were done within 3 hours, but just barely. They were not done immediately or anything close to it. The issue of whether Perdock was drinking will never be totally proven, but he was clean 3 hours after the accident. But that wasn't the issue. The issues are that he was speeding, in the dark, overtaking a sailboat who legally has the right-of-way, and more. He broke numerous boating laws and was never charged. Period. Oh, and he lied about being at Konocti. At least one security cop (and if you don't trust them to recognize him, who can you trust) testified that they saw him there, and another individual testified he had a beverage cup in his hand (which does not mean it was alcoholic). The point is, I don't think it mattered if he was stone cold sober, he shouldn't have done what he did and get away with it. And it is my opinion that the Sheriff and others contributed to that. They were not in Florida on business or for any other purpose, now Mitchell could prove this by a set of airline tickets proving by league and barker when they really left and went to Florida, but inside information says Mitchell fronted the money and sent them to Florida. To think that LCN or anyone else is that corrupt is stunning to say the least but that kind of stupidity is what has kept Mitchell in power for this long. As far as most people are concerned League and Barker are both corrupt Mitchell supporters and most want nothing to do with them. That is simply the fact of the matter.

Juror Misconduct Unfairly Led to His Conviction

Defendant Robert Hooper filed a Writ Of Habeas Corpus, CR922378 on August 30, 2010. The court issued an Order To Show Cause, on September 2, 2010. On September 20, 2010 Judge David Herrick said he needed to consider if there had been jury misconduct during Robert Hooper’s April 2009 trial, case No. CR 911597. Judge Herrick ordered transcripts of substantial portions of the jury voir dire be made available to the parties and himself.

A Writ of Habeas Corpus is a “legal action through which a prisoner could be released from unlawful detention,” according to Wikipedia. The transcript of the voir dire will show in detail the responses of juror number 08539, whom the writ is charging with juror misconduct. The purpose of voir dire “is to aid the attorneys in deciding whether to challenge a juror for cause and examination of prospective jurors is limited to matters that will assist counsel in making that determination. [citation deleted]. A challenge for cause may be based on the juror’s general disqualification, implied bias, or actual bias.” (California Criminal Law Procedure and Practice (2010) Chapter 29 Section 12 page 828.) In a criminal case the parties consist of the defense attorney and the prosecuting attorney.

The underlying case involved a battery. Defendant Robert Hooper claimed self defense according to attorney Anna Gregorian. A jury found him guilty April 1 2009 and he was convicted of a one count misdemeanor battery.

Anna Gregorian is the attorney filing this Petition for Writ of Habeas Corpus, which alleges, among other things, that Juror 08539 failed to disclose the full extent to which the person works and is associated with Law Enforcement.

The defense contends juror 08539 should have disclosed the connection between her office and the District Attorney’s office. Gregorian has filed declarations that allege that investigators from the District Attorney’s office also work in the Child Support Services and are at times supervised by the juror 08539.

Judge Herrick refused to consider further allegations of prosecutorial misconduct and ineffective counsel presented in a supplement to the writ. Judge Herrick stated those allegations would have to be considered in another writ.

Declarations included in this writ include Ron Stutsman, half brother of juror 08539, who stated, to his knowledge, his mother was not sick April 1, 2009, nor was his grandmother in ill health. The declarations counter statements by other jurors and the juror 08539. The foreman of the jury alleged that Juror 08539 told the other jurors during deliberations her mother was dying. When asked four months later Juror 08539 told the District Attorney investigator that during the trial, she received information her grandmother had approximately 3 days to live and her mind was on that. She mentioned she wanted to get the deliberations over so she go be with her family and she might have said something to the effect of I won’t be back tomorrow so we have to get this done today. This interview by a D.A. investigator was conducted about two months before the court released the juror names to both parties.

In another declaration, Attorney Patricia Snyder stated that after 2001, “Child Support Services shared a fiscal and personnel sharing connection with the Lake County District Attorney’s office.” Other declarations in support of the Habeas Corpus and the full transcript will be taken up October 4, 3:30, in Judge David Herrick’s court.

On the same date the writ was filed, August 30, 2010, Ms. Gregorian’s was given notice that her contract with Lake Legal Defense was terminated effective October 29, 2010.
 

Breaking news posted above on post 232, read it for yourselves and take careful note of the last paragraph, the citizens have to wonder why she(Anna Gregorian) was terminated directly after the last Writ was filed. It appears that those in charge of the PD's and those running the court system do not want fair rights given to the citizens but instead will attack at any opportunity to get rid of anyone who questions the system. In this case it is Anna Gregorian, who was dutifully respecting the publics rights and using constitutional law to do so, this is a sad state of affairs in our county, and these are perfect examples of the depth and terrible nature of the corruption in this county.

Anna Gregorian was not terminated. She gave notice that she did not wish to continue doing public defense and wanted to go strictly into private practice.
 

I have two children and living in Lake County is one of the most difficult things one can do as a parent. My children are teenagers, and it is hard for them to understand how a person like Mitchell can not only have the power he has but be so corrupt and be in power. How does one explain this to teenagers, how to give them the best moral up-bringing as possible, and then allow them to see the corrupt and illegal activities of a man be condoned by his followers as good. It is discugusting to see not only the local rags but those others supporting this man do so without a thought as to the terrible and dark person he is. What I must tell these children is, it has been a result of all the people in this county who in the past have supported Mitchell. But why to they support this guy when it is so clear how he is so bad. The only thing one can say is do not think that because a person is an adult they are also wise and honest and moral it just is not the case. Now Lake County can keep no youth in this county, they all leave the first chance they get, and it is a result of these people and their systems of corruption that are causing the downfall of this county. It is sad to me, but I have hope for change if we can start by getting Mitchell out of office. Thanks for letting me vent.

The Jury is in. Liz Larsen is found guilty of being in Rod Mitchell's hip pocket. A Witness testified, that when her and her husband's friend Marty McCarthy was in the race, Larsen said "I'm the one who will decide the Sheriff's race." That witness, fearing for his safety was only identified as Batman. Batman further testified that when McCarty withdrew from the race, because of self implosion, on "The Blog", Larsen switched candidates to White Supremacist, Rod Mitchell.
Larsen then wrote the famous editorial that became the center piece for Mitchell's hit piece just before the primaries. Larsen continued to show bias to the Mitchell campaign. Larsen and Jensen continually attacked "The Blog" and allegedly tried to hack the site.
Larsen's latest article on Oct. 2nd again shows it's usual slant of bias toward the incumbent. Many truths known personally by Larsen were either left out or twisted to favor the current corruption that exists in the Sheriff's Dept. Larsen attempts to paint the Rivero family as a family that likes to sue. It appears that Larsen thinks it appropriate for hospital gift money to be spent on gourmet meals and travel for staff.
Larsen was also found guilty of not checking her facts and hiding self evident truths. She accused local business man Tom Carter of being Rivero's largest campaign contributer. As she herself has checked the public records, she knows that Carter has contributed no money to the Rivero campaign.
An additional charge of stabbing Rivero in the back was levied against Larsen as well.
The court of Public Opinion has found Larsen guilty of these charges and is requiring Larsen to enroll in a journalism class to learn what the words honesty and integrity mean. She must also complete a course and write one thousand times, " I will no longer be a biased reporter and I will not let my husband abuse or push me around anymore. The restitution must be completed 25 days prior to the election. She is also being required to undergo surgery to disconnect herself from Mitchell's hip.
When asked to comment, Larsen's only answer was silence.

Great post 454 well done, I read it with great joy, as you remembered all the little incidents that have happened in the past with LCN, yes we destroyed her boy McCarty, and he was a close friend of John Jensen, oh you should have heard Liz touting the virtues of this guy, then claiming he is the "front-runner, it was at that point we understood the nature of LCN and decided there was trouble underlying the image they were trying to put out. Very Good indeed.
 

We hope that when the time comes Mitchell, LCN, and the Record Bee will man-up and admit the huge damage they have done to the county and its citizens. We are in a very difficult spot right now, and the corruption runs from one end of the courts to the sheriffs office and the BOS. It is sad to say the least that the citizens must live in fear of this group of malcontents, and it will be sweet justice to see Rivero win despite every single agency and Rag against him. We all know why they don't want to lose power, they know it we exposed and will continue to expose it, this cat and mouse game is over and the citizens have a right to a free and transparent operation of our local LE and government, we will fight the good fight until we get it.

You are so right post 547, nothing on Rivero calling Mitchell out, nothing on the comment by Mitchell which sunk him when he said to Rivero you could quit now and he even stunned his supporters with that stupid comment. Mandy is weak and she will learn in due time what journalism is and how she has hurt the citizens of this county, and done a dis-service to our community. Terrible!!
 

Oh my 552 get a grip, the citizens run this site and the two newspapers called the Manifest. We are speaking to the citizens, and we started this site without even knowing who Frank Rivero was, it would not matter who was running against Mitchell we would be with them and going after Mitchell. You cannot really be supporting a maniac like Mitchell and be in your right mind. Truth is what you speak, give us some truth about your boy Mitchell. Give us some truth about Garzoligate, Dinius, Beland, Wright, Moreshed, infidelity, contracts, his connection to the DEA and the activities of some of his deputies who attack the public who lie to the public. Over and over again we ask you to document and support the leadership skills of Mitchell never can you post something positive, never can you justify his actions and his terrible record of performance. Frank Rivero said it right in the last debate, "you wonder why there has not been anyone run against Mitchell, the answer is sitting right there as he pointed to Mitchell." As some of you may recall we posted an article called the curious case of John Stoddard, concerning his battle with the Rivera Homeowners association, we are receiving documentation of this amazing story, as it has now gone to court and the battle is being waged. It is not a pretty picture and shows the corruption from the DA to the Sheriffs office to Gary at the Record Bee to many others. We will posting an article in a day or so, and what you will read will blow your mind.

We will give you one example: How would you like to be told as a homeowner or a lot owner that you need to cut your weeds and you must use a licensed person to do it. Then when you are given the name of a weed removal company, it happens to be under a phony name run by people who are on the homeowners association!!! Oh ya, and it gets much worse then that, and goes very deep into the sheriffs office and the DA and others. More to come on that.

We get very angry, when you so belittle these tragic deaths, and continue to support a system and a man who has this record of performance. It is in a word disgusting at best. How can you not see these basic realities these truths, none of this is made up. This is all documented incidents and deaths. Could you please take at least a small step into the world of reality?

Hey Al B. Just check out the commendation to Rivero by the police chief of San Francisco in the Saturday RB. I think that covers whether he is fit or not to wear the uniform. I don't think you will find anything in Mitchell's background to equal it. Also, I am one of the many local citizens that are not Marijuana growers or users, and find your calling us that to be offensive and should be retracted. You are not speaking honestly, and your comments show that your intelligence(?) should be questioned. Furthermore, I know personally that Rivero stays away from this blog. He doesn't read it, and does not contribute to it. It is the people's place to state our opinions, and sometimes facts, in order to rid this poor County of Mitchell and his henchmen.

Bruce, I mean Clark Kent, that is B.S. Francisco is part of this blog and he does read it and contribute to it. Mitchell also received commendations from the sheriff of Lake County before he became sheriff. Mitchell was also voted as "officer of the year" back in the eighties. It was the deputies that voted, not the management. Mitchell received a couple commendations when he was a reserve in Sacramento. You guys continue to tell lies on this blog. And why do I continue to read it? Just to keep an eye on what B.S. you continue to post.

I am not Bruce, and not related. So Mitchell gets a commendation. For what? Rivero got his for his actions as an inspector fighting a gang of drug thugs that was terrorizing the people in the Hunter's Point district of San Francisco. And he was instrumental in bringing them to justice. And for you folks who missed that commendation. It is in the Saturday RB. Of course Rivero had to pay for an ad to put it there, because the RB, I'm sure wouldn't do it.

SO, the Sheriff is responsible for crap that happens in the city of clearlake. He is also responsible for some drunk who decided to drive his lark down the freeway. Mitchell has kept the department within budget for sixteen years. Mitchell implemented a evaluation system that was not based on favoritism. Mitchell attempted to help increase benefits for sheriff dept. employees so as to help keep people at the department. Mitchell obtained grant funds to improve the dispatch center so it would give the citizens better service. Mitchell obtained grant funds to improve the jail. Mitchell started the citizen academy and has continued the citizen academy throughout the years. Mitchell has continued to try and update the equipment for the deputies so as to deliver better service to the citizens. Mitchell has attempted to locate funds to put MDT's (computerized systems) in the patrol vehicles. For those of you that don't understand, it is not just purchasing the items for the vehicles. One also needs to put in new antennas/repeaters throughout the county. The cost is millions to put this in place. He is still trying to locate a source of funding for this program. That is just a few of the things he has done.
 

Again I'll take some time to educate you. MS Rhully did NOT file a police report. She made a citizen's complaint. Either you're mistaken in your belief that she did, don't understand the difference between a police report and a citizens complaint, or you are deliberately not telling the truth. Whichever way, the facts are out there now and your whining and lying don't change them.

No programs for the inmates; Mitchell should follow Sonoma County, programs for inmates if he cared at all for humanity......Instead of the Citizens Academy
why doesn't he invest in CPR education for his deputies, since most 85% of emergency calls in Lake County are health related or hwy accidents. If radio repeaters and computers are absolute necessity, or priority; then he should have taken care of that priority first but still hasn't; seems that would be the most important item on his agenda........he has to get his ideas from his opponents to

I see this from a different light, in the same manner that I see Joe Ford, I see the aspect of Kip Ringen. Both made their choices based on far to much of a personal reason. I will point out some major flaws in the Mitchell supporter comments (or Ringen, if it was you).

Rivero spoke out in public only AFTER Rully went public on the airway.

Did you also forget that Rully had filed that complaint in January, but LCSO (Mitchell) sat on it for four months, just weeks before the Primary.

It was also Rivero's private investigator who had to find Rully's husband to get his side of the story. Kip, don't you remember Rivero's confrontation with Mitchell in the parking lot over that report?

Now as for the Rully caper findings, Rivero read to the audience the letter sent to Mitchell by his lawyer requesting Mitchell release the findings. Mitchell countered but didn't make any sense. Rivero was cleared. No other finding was made to hold that report until after the election. Rivero either did it or not and it is that simple.

A person can better himself from teenage rebellion. Rivero did get arrested, noticed either his problem and/or problems with the cops and decided to change. He headed to California and never had a problem with the law since. SFPD not only hired him, but promoted him to Inspector in just four years (almost unheard of at SFPD).

I will also point out that you stood by Rivero and Lande's side on national TV. Are you know stating you lied to the public? You might want to watch your interview again.

Ask yourself this Kip. Mitchell said there is no performance rating for arrests, yet you did my Eval, gave me the total arrests and compared them to others on my shift. Macedo also put two other deputies on a PiP for low arrests. Why did Mitchell lie?

Mitchell said there is no racism at LCSO. Yet I remember sitting next to you when Hall started his slanderous remarks on Morshed. How about the photo on Mitchell's wall. Is all LCSO deputies racist? No, but the management sure seems so. Four EEOC complaints and going.

Mitchell supporters you are fighting for a cause yet you have no cause. What you have is an inability to promote your own man. You know your only hope as we have said over and over is to make the often used attempt of bringing Rivero down to Mitchell's level. We have never ceased to be amazed, at the lack of comments which the Mitchell supporters have ever provided taking in a positive manner about Mitchell. Only 1/10 of a percent at best of the total comments in one year have been a positive post about Mitchell. Yet let us remind you of the cause for this site, you may have missed it at the top:

I know Kevin Burke, and he is a good cop, very intelligent and I have never heard a bad word said about him. He is serious regarding his career, and when the opportunity to move ahead shows itself, he takes it. Good move Kevin. Could it be just a coincident that he will be leaving Lake County just a few days before the elections take place. I am sure that Kevin does not want to be involved with this nasty and sometimes hateful election, so this new position came along at just the right time. Hi it is my first post ever and thank you for the forum. I am posting instead of reading because I want to ask for a forum on the manifest called Judge Watch. A place to post comments, injustices, racism or other problems spotted with our local judge. Can you please create such a forum? All four judges are up for election in 2012 and there are issues the public needs to be aware of with a few of these judges. There is no oversight at all and we need some. I think the Manifest can fill that void and help us prepare for that election. Thank you.
 

Who cares what Mitchell has offered to buy off Ringen and Markham. Mitchell has been making his back room deals for years and these are just two more that we know about. Consider all the facts and not what Mitchell calls facts and make your choice. It's Rivero and Mitchell running for office not Ringen and Markham.

Mitchell threatened to destroy both Ringen and Markham in the past when they made noises about running against him. It worked since he scared them off. Who knows what he has on them over the past 16 years that they don't want to come out. Either way both backed out of running.

Mitchell launched a campaign of lies and disinformation against Joe Tortorico for running against him in 94. He was successful in scaring the people through his lies and deception and he won the election. Now he is doing the same thing to Rivero using his thugs to try to frighten people. He's sending these people out to intimidate people with Rivero signs in their yards and trying to scar them. Most are getting angry at this tactic just as people are getting fed up with Rod's lies and negative campaigning.

Rod Mitchell is showing his true colors in his campaign to stay in office and continue intimidating the people of Lake County. There is no question he serves special interests and not the people and it's time to put an end to it.

Mitchell has been taking advantage of a flaw in the sheriff's system in our state. They really are not accountable to anyone, the huge amount of time it takes a citizen to bring attention to a bad sheriff through the AG or any other agency is terrible. If you do not have an honest and moral individual and he is there for 15 years with no oversight that is as Mitchell has proven is a bad recipe. There needs to be some chain of command established so sheriffs are accountable and watched, and that model has to have direct accessibility to the public. People are at the mercy far to much with a sheriff as racist and hateful as Mitchell is, and it is not just race it is anyone who does not abide by the game, or tries to change it. Look at what Phil Murphy did for quite a while with the free press newspaper, but it didn't change the sheriff and it didn't change the MO of this corrupt group.

Did you notice how mitchell was playing to the attorneys in the debate? Mitchell was trying to tell "them" how a court room worked? I think mitchell was practicing for all of his up coming court dates. Why doesn't mitchell quit now so "His" position can be filled?
 

Why doesn't Rivero quit now since he has publicly stated that he does not want to be a Lake Co Sheriff's Deputy?
 

He stated that he would not stay in Lake County if he did not win. This by the way is one of the saddest aspects of Rivero not being sheriff, there will be a flood of people leave the county. Many could not stay here if the county proved itself to still be so redneck that they would keep a man like Mitchell in. It would be a continuation of the deep south mentality of ignorance and basic stupidity seen in the 50's and 60's and still existing in some parts of the country such as Lake County with Mitchell as sheriff. One hopes the population of the county has grown and progressed to a higher state of understanding by this point in time. Many wonder, from the outside they look at us and say, well we will see if they have grown enough to rid themselves of a low and vile redneck racists like Mitchell and his supporters like KKK Klint. Have we grown out of the dung heap of corruption and ignorance to be able to free ourselves of this cancer.

This is a nice place to live but no thanks to Mitchell and his corrupt SO. It's nice in spite of them and the sooner we get rid of them the better this place will be. He's had 16 years and has failed miserable. Just look at his record of mismanagement and lack of leadership. Look at his record of arrogance, lying and vindictiveness. This is not a law enforcement professional, this is a corrupt politician and we've had enopugh of his kind.

Let Mitchell sing how much he loves Lake County, he loves the law, he loves the Deputies and he loves the birds and the bees. What BS and it's difficult for me to believe anyone would swallow this especially with all the public officials being exposed around the country for doing much less then Mitchell.

I got my ballot in the mail yesterday and today it is being sent back to the Registrar's office with my vote for Rivero! Don't forget to mark it with a #2 soft lead pencil so that the machine can count your ballot! Any dirt you have on Rod should be posted soon so all those ballots that are sent to the homes can know to vote Rod OUT not only for his current corruption but for his past as well - what was it someone said about can't change your ways, well Rod is a corrupt politician and he won't change. When some one like Rivero is arrested in his late teens and at 20 for drugs and car theft and wants to be my sheriff it’s important to me. I would not let a person arrested as a child molester around my children even if it was 30 years ago. It is like the old saying they can't change there spots. And it was not 30 years ago that he was trying to hide this from us it was just a few months ago it all came out, so that tells me he is not a man to be trusted. And because the group running this site helped him keep this quiet you also can not be trusted...
 

The question we need to ask ourselves is do we leave things as they are our try and change them? I for one would not care to be the next Dinius for this local bunch. All their tripe to justify their actions only show how they have lost touch with what government is about. They would dishonor themselves as our government. We should not have to explain the wrong they have done. so how did we get to here? because the system allows the arrogance. To lie and cover the lies up has become embedded in this governments. Its that power corrupts and absolute power corrupts absolutely. Those that took a oath and should known better forgot their oath. No bureaucrat has stood up so the citizen has to. When Mitchell hired Rivero, Mitchell stamped Rivero with his seal of approval to become a Law Enforcement officer in Lake Co. Rivero background wasn't in question, Mitchell approved it! If anyone questions Rivero background, we must also question Mitchell hiring practice,

Good morning Lake County a great day of comments yesterday, absentee ballots are hitting the mail boxes over the next couple of days and the voting has started. This is the biggest election Lake County has ever had and it officially starts now.

Everyone please plan on attending the debate this evening in Middletown 7pm, everyone find a way to get there and support Frank Rivero, there will be no more debates, which is good in one sense in that we do not have to hear the word specificity ever again.LOL and we do not have to hear Mitchell's like ever again. It will be very important directly after the election in November to keep a close and watchful eye on Mitchell and his cronies, the things they will try to cover-up before their departure is very important to try and keep an eye on. Mitchell and others will literally be trying to keep themselves out of jail and out of trouble, the shredders will be spinning and the documents secreted out of the offices and files of the sheriffs.

But the immediate is most important and that is getting out the vote helping the campaign in anyway you can, phone help is needed as well as walking and going door to door. Do what ever you can to make it to the debate tonight to support Frank Rivero.
