Good News for stressed out Sheriff Mitchell, NO on-duty Deputy arrested last night for DUI.
 

More good news for Mitchell no more husbands coming out about affairs .
 

It appears quite clear the Mitchell has indeed violated chapter 5 use of public resources for campaigning in an election, this comes from the commission state of California FPPC, this commission has the authority to impose fines, and litigate civil procedures aganist those individuals illegally participating in that activity. Their guidelines in accordance with state guidelines are very clear on this, and the Mitchell clan has done so in the Middle Town parade on Saturday. Formal complaints will be filed with the FPPC along with requests for investigations of the enforcement board. We will update you on our further actions we will take concerning this situation.

An off-duty sheriffs deputy hit by a Taser by police officers responding to a 911 hangup has been awarded more than $300,000 by a federal jury.

Merced County sheriff deptu Domingo Leyro received the award Friday after a week long trial in U.S. district Court in Fresno.

According to testimony, Leyro was Tasered in 2007 by Chowchilla police officers responding to a 911 hangup made by the deputy's girlfriend, who on a callback to dispatchers everything was fine.

Officers arrived at Leyro's home and asked to see the girlfriend, and Leyro closed the door and went to get her. After going inside, officers ordered Leyro to stop walking and say he did not obey, so they fired Tasers.

Leyro was charged with and acquitted to resisting arrest. He also lost his job, but regained it.

Will Lake Co. have a shooting like BART did last year?

Lenny did a great article that is in the Manifest on tasers, and she has usage numbers, costs, and all the details in that article. If anyone has not read it you should take a read of it. Very informative. I think one of the issues that should be addressed in regards to tasers is the psychological effect they have on officers. It appears they are much more likely to use them then is necessary. That is if they did not have them and consider them a "non-lethal" tool, they would use other more conventional means of dealing with the public in those situations. The guidelines for use should be far more controlled.

People seem to forget that officer's have other items to use that are within the "less than lethal" weapons list.

The police baton, nightstick, billy club or whatever you call it has been around since Sr. Robert Peel started the first police force. When used properly, the baton causes bruising, broken bones and dislocated bones. In 1985, Deloris Sworta (might be spelled wrong) was a protester in San Francisco. She refused to leave and was pushed back by riot police. She was struck several times to the point that she later lost her spleen. From my experience, I've seen wounds causing severe bleeding to a few deaths. Rodney King was another example of misuse of force with the baton.

The next item is the Pepper spray. Most everyone has seen an episode in Cops where the spray did not work. Most fights cops go to involve booze and/or drugs. The spray almost never worked for me. But great on attacking dogs. Spray is also very dangerous in an enclosed are (such as a jail) since the CO usually gets consumed by the spray too.

Now the taser. When misused (JUST LIKE ANY TOOL) there has been death resulting with the primary cause being the taser. When used properly, there has been no deaths primarily caused by a taser (http://www.taser.com/legal/Pages/Default.aspx). I've never seen a broken bone, dislocated shoulder or even a concussion caused directly from a taser. The only death in Lake County has been from CPD and the primary cause of his death was "DRUGS".

So think of this, do you want the CO to beat the offender into submission, be overcome by spray fumes causing the offender to attack the CO or have the CO use a taser. I've been tasered several times in my training. It "HURTS LIKE HELL" but It's over in 5 seconds and no injuries.

That's a great post 1035, if you don't mind I am going to copy it over to the Manifest newspaper article as the input is quite valuable. I think part of my perceptions as well as others is built by the "media".. Your point is a good one, and I would suspect that in total the amount of deployments of the taser by officers in the thousands perhaps each day across our country which result in a less harmful arrest then otherwise may have happened is important. Of course we don't hear about those in the media as it is not deemed "news" worthy. But what we do see is the reports of heart attacks and such when the taser is deployed, as that is "news" worthy, so it is a slippery slope indeed.

I do think there are instances due to the non-lethal aspect of the system that some officers may use it when with out harm an arrest or take down could occur by "normal" means. If I were to understand that officer training includes the idea that this weapon is to be used only when absolutely necessary then I would be more comfortable. I noticed that recently an officer was trying to stop a young women on the street I believe for jay-walking and this girls girl-friend tried to intervene and attacked the police officer. He did not use his taser, but did punch her right in the face to get her to stop. He could have used his taser, but elected to throw a punch. What happens he is getting hammered for throwing the punch!!! As I said a slippery slope indeed. Thanks for your input.

Almost everybody has a video camera and could video any police officer at any time . It is of utmost importance that police officers are well trained and follow procedures and policy when it comes to use of force . The best tool an officer has his ability to defuse a volatile situation unfortunately I know to many officers that go out looking for altercations .

Exactly what training do these guys and gals receive? What kind of background check is ran on them. When having a conversation this past weekend with a ex-sheriff, she stated that upon her acceptance into LCSO that they never gave her a drug test. I could not believe this. Why would someone not be given a drug test before acceptance into a position such as LE?
 

All good questions above, we have a lot to do as citizens to bring this county into compliance with these issues, we have been quite focused on the elections and as everyone can tell there are many issues that need to be addressed in our fair county. This change is going to encompass a great many areas from the city of Clearlake to the Board of Supervisors, the citizens will in the long run take control back of their county.
 

This goes out to Sarah - Suggestion: Call Sheriff Mitchell and ask to meet with him one on one. Then call Frank Rivero and ask to meet with him one on one. See who answers your request! We called Mitchell many times to come out and speak with us and help to answer some of our questions, he never returned our call and never showed the slightest interest. Frank Rivero, returned our call, set a date to come out, came out, joined us for dinner and we were able to ask and get some of our questions answered, he showed alot of interest! You will find as we did, that Mr. Rivero is a very sincere fello!

Flash Flash we have just received some interesting information concerning a tactic that Mitchell used during the primary campaign. We are investigating this at this time. What happend was this. Mitchell used the names of several prominent Rivero supporters. He used them in recordings he made to call citizens and leave recordings on there phones these recordings using Rivero supporters names were telling people to vote for Mitchell!!! That's right highly illegal to do, we want any citizen who has gotten any recording from Mitchell on their phones to get those messages and let us know. We only need one saved recording to prove this activity. Please let us know by e-mail if you have a message of this nature.

2:34, I think the CHP is not going to give anymore "passes" to anyone with a badge. I know probation officers have badges in their billfolds. CHP Fredricks was aware that "Steve" was part of LE. I don't think that Mitchell supporter's comment that CHP are nothing more than "glorified Tow Truck Drivers" helped matters any. CHP has always been a "class act" except for one or two "bad apples". Times are changing...

They simply look at this mess and laugh to themselves. Nor will they engage in mudslinging with the LCSO corruption supporters. Period, They simply will not stoop to those levels. We already know that upper management of the CHP will have nothing to do with Mitchell, and we all know what their opinion of him is, so that tells you alot about Mitchell. I think the LCSO corruption would be wise not to throw stones at the CHP their record of performance far outshines the antics of Mitchell and his boys.

Why did Mitchell not take action right away when he found out Perdock accessed the Dinius case?

Why did Mitchell involve himself with Perdock at the scene?

Those are the questions you should be asking, not making up things.

This post came from Mitchell's site. How are they going to answer this one?.....It would be pretty hard for Mitchell to have a affair in the evenings and days off when he has family at home. So does that mean that Mitchell used a county car and dated his lover on county time?
 

Actually it is less comments then that because one of them was the article in LCN that destroyed LCN's credibility, you know the article that said people were in the proximity of Rivero! They actually used that opinion piece...LOL So the way I have it figured that was an average of .07 posts a day. Strong very strong! These guys no how to model and execute a plan that is for sure. And then to copy what Lovelace did and still fail at it. my goodness.

158 comments in 24 hours, not including the comments on the Manifest, of which by the way tommorow will be the debut of the actual full on online paper, graphics enabled, interactive comment system, a beautiful looking site with continuous rotating header qraphics. Well they are telling me not to give all the kool stuff out till we make the official announcement so will stop there.

This is the citizens making this happen, this is all because you people care, and know the change has to happen. This is beginning the true model of transparency and community that the citizens are creating. Think about it Lovelace didn't do anything, just created a stage an avenue of communication That we protected from the corruption supporters and the elitist who tried in every way to take it down. Otherwise all of you are doing this.

I for one am thankful for being able to be a part of this. There is a long way to go. But it is going to happen. I think most people feel that now. Like we really are causing change and it is going to succeed. Just keeping it real.

Flash to the citizens of Lake County, members of the Lovelace group have just presented to the Board of Supervisor's in the Tuesday meeting our actions that have and will be taking place in regards to the Middle Town Parade and Mitchell's use of public resources to run his personal campaign for these elections. We informed the board that we have submitted to the FPPC our findings of Mitchell's activities during the parade and our documentation of his use of public resources for those actions.

We are submitting to the FPPC and the board of supervisors our findings. We informed the board that we have engaged in conversations with the Fair Political Practices Commission and their agreement to accept our request for investigation.

We also will be filing a complaint to the DA for review related to possible criminal Attorney General state of California. We will request that this issue gets placed on the Agenda for next Tuesday or the following Tuesday.

The governmental codes we are bringing to bear are Chapter 5 sections 8314 sub sections 1-4....In the case of Rob Brown we are asking that he be reviewed by the BOS and the FPPC for participating with sheriff Mitchell in the illegal use of Public resources for personal campaigning.

We will be posting an article on the Manifest tonight or tomorrow in regards to this process and what our actions are and will be.

I keep reading about how CHP is not going to give anymore passes after this situation with Smith....But guess who wants a pass when they need it. My husband is a police officer and I won't say the agency because he would be pissed if he knew I was writing this....But he has contacted CHP officers and the first thing out of their mouth is I AM A CHP OFFICER...His reponse is, "always remember that when another agency wants a break." Please be aware the CSLB contractors state licensing board and the employment department are in the county today and tomorrow. They are checking all contractors for license, workers comp, proper payroll, employees, and other areas. It appears they are hitting any and every site they can, and those that are licensed contractors should take what necessary steps you need to to protect yourselves. For those unlicensed and doing minor work you to must be careful as they will check for the 500.00 material and labor requirements and other compliance issues. Heads up all licensed contractors and handy men, there are stiff penalties and actions that can be taken if all your ducks are not in a row.

Subject: Use of public resources for the purposes of personal election campaigning by sheriff Rod Mitchell. The participation of Supervisor Rob Brown as a county supervisor in assisting sheriff Rod Mitchell in these potentially illegal activities.

Overview:
In the brief summary presented to the BOS on Tuesday June 22nd a great deal of legal and civil concerns were presented to the Board. In light of that we are compelled to present to the Board this draft and documentation of what actions have been taken, what actions will be taken and our requests to the Board concerning this matter.

The guidelines required by the Fair Political Practices Commission, (FPPC) prior to submittal of a request for investigation and a sworn complaint submission is a review by phone with them to acquire their approval of the submissions and requests for review and complaint. This has been done and it has been agreed that there is merit to our allegations and they will accept our submissions.

The contentions are two fold: 1. That Rodney K. Mitchell has used public resources for personal campaigning. In this regard we reference state government codes as follows.
Chapter 5 of the California government code:
Section 8314 (1) and (a)
8314 (2), (3),(4)
This includes the aspects contained in 82015 and 82025
These sections cover use of public resources, definitions, and guidelines.

This is a brief overview concerning Rodney K. Mitchell: Recently (6-19-10) a parade was held in our county in the town of Middle Town in the south east section. We believe there was an illegal use of public resources by Mr. Mitchell as he campaigned during this parade. By virtue of using a massive amount of county sheriff vehicles and county resources, including swat vans, OES trailers, police dogs, potentially on duty uniformed SO's, and other county equipment and resources. All of these resources are funded by the public and specifically covered by the above mentioned chapters, and sections. The actions constituting campaigning are fully documented, they are on film and in photos and witnessed by numerous individuals attending the parade. These actions as well used fuel, depreciation, possible payroll, uniforms, officers, and other transportation costs as well as other resources to numerous to document in this short presentation to the Board.

2.Participation of Rob Brown: Mr. Brown seems to be under the impression that our concerns lie in his use of his own vehicles in the parade. The potential civil violations are centered around Mr Brown working in the capacity as a county supervisor, and assisting sheriff Mitchell in these potentially criminal activities. Mr Brown can and it is his right to endorse sheriff Mitchell, however our review with the FPPC has indicated that his collusion with Mitchell in setting up the campaign parade and assisting in the use of public resources is wrong and opens the door to potential civil actions as well as actions by the FPPC. In Mr. Browns case we will let the FPPC take our documentation and further determine the grounds on their part for action in regards to Mr. Brown. Based on the serious nature of this situation and Mr. Browns activities we are asking the board and county counsel to conduct a full review of Mr. Browns actions and stop any assistance that Mr. Brown would give to sheriff Mitchell in the future include no use of public resources. Mr. Brown can campaign for sheriff Mitchell as he sees fit, Mr Brown cannot participate in any manner with sheriff Mitchell actions while using public resources. The level and degree that Mr. Brown participated in this parade campaigning is inappropriate, and should be reviewed in fine detail as to how and when he assisted sheriff Mitchell in the movement, and usage of any county/public resources. Since it is our anticipation that the board will see clear to admonish sheriff Mitchell to cease and desist in any further campaigning using public resources, Mr Brown may do as we wishes in regards to his endorsement or assistance he may give to sheriff Mitchell. However we are going forward with our request for investigation by the FPPC of Rob Brow
 

2.In regards to the activities described concerning sheriff Mitchell our focus is three fold.
a. Our contention is that sheriff Mitchell has violated the chapter and sections as described above. That these activities are criminally prosecutable. Various aspects of his activities will be forwarded in our documentation to the FPPC for their review, and we will leave any actions they would deem necessary to their discretion.
b. Our further contention is that a request for possible criminal action against sheriff Mitchell be presented to the District Attorney for review, and we will move forward in this regard.
c. It has been suggested that the complaints and concerns we are presenting to the board are egregious and serious enough to warrant presentation to the state Attorney General. We will go forward with that process as well.
3. Due to the fact that the elections are upon us and that these matters can take many months to be completed. We humbly and with great regard to the necessity for fair and honest, truthful and transparent elections in our county, are asking the board and or county counsel to assist us by the following means.
a. Ensure that for the remainder of the elections and campaigning processes sheriff Mitchell does not utilize any public resources in any manner by inference or direct utilization of any public resources. That if sheriff Mitchell is going to use even remotely, any public resources, that the board require approval by their determinations of potential illegalities throughout the remainder of the elections.
b. That the Board and or county counsel review Rob Brown's activities in his assistance to sheriff Mitchell with specific focus as to what assistance Mr. Brown provided in the movement, use, or other collusion in any manner, to sheriff Mitchell's use of public resources. That Mr. Brown is cautioned to use all due discretion in his activities in assisting sheriff Mitchell, and that the Board and county counsel approves any and all activities if even remotely connected to the use of any public resources.
4.It is our desire that the remainder of these elections are conducted with a direct focus on fairness and mutual agreement to the established state guidelines including moral and fiduciary responsibilities. We further request that the board put on its agenda as quickly as they deem their schedule permits a report to the citizens and offer an open discussion with the citizens in these matters. We further believe that if these activities cease immediately and the remainder of the election campaigning is fair and just, our options to proceed with litigation requests and reviews by those entities referenced may,at our discretion may be stopped.
 

You will notice in this last post the connection to Homeland security who we will be reporting to and have made an initial contact with. This is a federal issue and very serious,


In a very serious potential ramification of sheriff Mitchell's activities we would like to remind the board that some of the equipment used in the campaigning parade was funded by Homeland security. In a brief contact with homeland security their response to Mr. Mitchell's use of this equipment in the parade and in the described campaigning was cause for great concern. The possible effects of the illegal use of this equipment holds great possibilities of severe actions on a federal level implicating both the county and sheriff Mitchell personally. We are, in this regard reviewing our options in furthering our contact with Barbara Boxer, the DOJ, and continued discussion with Homeland security.

We are for the boards convenience including the initial draft of the document being sent to the FPPC. This document is not all inclusive as to the information and myriad of details being provided to the FPPC. But will provide the board with the general overview which mirrors some of the details we have provide in this draft. If the board would assist us in informing the citizens as to when this may be put on the agenda for the board meetings we would appreciate it.

What this means by the way is Rodney is now under official investigation by federal authorities through investigators at the DHS/OIG....Office of the Inspector General/Department of Homeland Security.
