A panel called " The Independent Civil Rights Commission" is currently holding hearings in Yolo County on civil rights abuses by Yolo County Law Enforcement. Maybe the Lovelace group can call them about the civil right abuses here in Lake Co.

I truly think that there is not one person in this government that intends to be dishonest. That said when things go awry the system will allow those that are dishonest freedom unless exposed by higher authority.
 

I'msure you are right 631, LCSO must have some very good, honest and professional people but they are hiding out so they won't be noticed by Mitchell and his gang. These are the ones who don't have dirt on the sheriff so when he goes after them there will be no endless administrative leave with pay.

My job takes me to all parts of the county where I am able to talk to many people. The complaints and comments noted on this blog are not isolated concerns. People all over seem to be concerned with the same issues of corruption, mismanagement and lack of leadership in our sheriff's office. Many who voted for Sheriff Mitchell in the past have expressed disappointment in him and plan to look for a better and more qualified candidate for the office.

I want a person to replace Mitchell that has a good knowledge of exactly who is playing politics's with deputies careers, who exactly are harassing employees and who has a plan to address it. That is why I vote for Rivero. I like Baxter's experience, it is full of good training from a great agency, but I want someone who has already spoken up against Mitchell. I want a person who knows who is the problem managers and the ones who only want to kiss ass. If Baxter was a retired part time deputy or even a volunteer, he would have my vote, but he never was. I like Baxter, but my vote is for Rivero. Rivero is the only deputy to stand up against Mitchell and not scared of him.

Hopkins said on the radio that he does not know how much it cost us for him to take Dinius to trial in our name. The BOS thought it was important enough to audit the SO over Garzoligate. Wasn't that about mismanaging our money? If Hopkins Budget? Has so much of our money in it that Hopkins feels there is no need to account to us for where and how our money is spent maybe It is time for a internal audit of his dept.
 

Look at the Grand Jury Report 2009 on the District Attys office; I'd like to know how the DA is going to report back to them....there was a huge discrepancy of money?

money and "lacks policy" and has un-experienced DDA's [educated but not experienced]

Why would a candidate need to be a deputy, volunteer or part time employee to reorganize and correct the damage caused by Mitchell? The internal apple polishers will be all to evident and will find there is no business as usual. I want someone from the outside who has not been tainted by the internal problems and who will work to create a professional organization that is open and fair to the deputies and the community. I'm going for Baxter's experience and strong leadership and work ethic to make our sheriffs office into a modern, professional, community service oriented organization.
 

We need someone who will stand up to the GOB's and motivate people. Someone who refuses to roll over for internal politics. I think Rivero will find he's battling his internal enemies every day which could result in a department collaps or resistance and upward discipline. Many of his ideas are good but he may end up spending four years fighting with Mitchell's gang still in place.

Although I come on the site to fight my fellow deputies that support Mitchell, I will gracefully inform you of several key problems with Mitchell:
1. Mitchell was on scene of the night of the Dinius case. He hugged Perdock but did not contact the victims. He refused to call for assistance until three days later. He fired Beland for his testimony and now Morshed's going down too.
2. Mitchell is the head of the department, but he failed to read or even have someone proof read Garzoli's DEA grant. That will now cost the county a lot of money.
3. Mitchell knew about Perdock accessed the boating accident report that he been told not to access. Any other deputy would be fired.
4. Mitchell was aware of Wright's theft and possession of stolen LCSO property, but instead of an arrest, the incident was filed as a complaint. Then when the press found out, he directs investigations to arrest Wright.
5. The crime rate while Mitchell has been Sheriff has increased, not decreased (except on one field). Go to the LCSO website and read the statistic's.
6. Mitchell had four deputy FTO's challenge Lande publicly on a LCSO website when Mitchell knew that Lande only had a beef with on FTO/Sergeant.
7. Mitchell has possession of the EEOC complaint investigation, but refuses to release the information.

In a small community such as this, small town mentality does not mix well with large towns such as San Jose. We don't have the money they do or the equipment.

Rivero knows exactly what manager plays games and kisses ass. Rivero has a history of not backing down and even challenging Mitchell in public.

Rivero has a strong coroner's background second to none of the candidates including Mitchell (remember the Sheriff is also the county Coroner).

Rivero has seen the mismanagement and challenged them in public.

Rivero doesn't back down. His past law suit with SF covered a 15 year court battle. Rivero never backed down even though it cost a lot of money.

Rivero knows the county and has been at several meetings with community leaders. I still have not seen Baxter or McCardy talk yet.

Rivero has a clear cut plan that can be read on his website. Even Baxter thought it was a good plan.

I will not try and slam Baxter's experience, I just think Rivero has already shown himself that he cares about this county.

Change for the sake of change it not a good thing however every program needs to be critically reviewed and improved where you can. Every project can be improved so you must be flexible and prepared to make change if needed.

Lake County does not have the financial resourses that larger communities have and in many ways must make do with what we have. This does not keep us from having goodcommon sense ideas that work anywhere. We must be open to new ideas and not settle for business as usual which we've had from Mitchell. His management has failed time and time again and he will not consider the fact that he may be doing something wrong. He is unwilling to listen to anyone but himself but he will p[romise the world then never come through.

Give our citizens credit for wanting to do the right thing. This blog demonstrates that. Rivero took Mitchell on first and marked himself in the process. Hopefully we'll see Mitchel go packing soon and it won't be an issue. With Frank's background in the Mortuary business I've wondered why his talents were not put to good use in the Coroners department. Round pegs in round holes is good business.

If Mitchell is reelected Frank acknowledges he will have to resign before the sheriff finds some some way to get rid of him for having the nerve to cross him. If Mitchell fails in his attenpt to be reelected there will definately be a place for Rivero and any other victim of the current administration.
 

To Hopkins, What right do you think you have to tell us that you don't have to explain how you spend OUR money?
 

If the new sheriff needs money to improve the department and services, Why not get it from Hopkins? If Hopkins doesn't know how much he spends he can't know how much he has. If he doesn't know how much he has then he has too much.
 

That's the arrogant attitude that marks both the DA and the sheriff. They've forgotten who they work for. They believe tax payers should be seen and not heard and never shall they ask questions. Well, those days are over and its time to show and tell (the truth) because we are not going to sit down and shut up anymore.
 

When we have a Grand Jury that is not connected to either dept maybe they will put the citizens concerns first and ask the hard questions. Maybe then they will realize that they are a Grand Jury first and a Civil Grand Jury second.
 

The more people you get to put their hat in the ring and run for sheriff, the easier it will be for mitchell to be re-elected. The mitchell hater votes will be split among 3, 4, 5, who knows how many candidates come election time. Even if you were able to persuade 75% of the voters to not vote for mitchell, he could easily end up winning. Keep up the great work lovelace. thanks again

Any news on Garzoi, Perdock or Morshed? Here is a though, what if Morshed did not leak that information. That would mean Mitchell retaliated due to Morshed's EEOC complaint. It can't be about his testimony in the Dinius case, since that is more than a year old. If Morshed did it, throw him to the wolf's, but if he didn't, I hope Morshed throws Mitchell to the wolfs in the form of a big fat law suit.

Great posts today we have been working on our final draft of what we are going to post this evening. We will be asking alot of questions and presenting the results of our latest investigation. One quick point concerning Baxter, he must embrace the idea of citizens oversight, and he must come up with his defined and detailed plan for that citizens group. Rivero has an excellent plan well thought out, and covers all the bases including funding and functionality. Mr. Baxter needs to come forward with his plan and idea during the election. No plan means no votes period, the citizens of this county have been left in the dark far to long, and whoever is running must develope and present a very defined and well thought out plan alomg these lines.
 

I agree with the need for a citizen’s oversight committee but this committee is not the only improvement necessary to overhaul the department. I agree that Rivero has defined his plans so we all have a great understanding what Rivero is all about. Given Baxter’s qualifications and his experience, I for one believe he is more than capable of adapting to Lake County’s needs, budget constraints, and brown-noses. I also believe that being a newcomer is an added plus. He will come in fresh and take each deputy at face value, just them on their own merits, not concerning himself with who they know or who they are related to. I’ve had the opportunity to speak with a few of Baxter’s former co-workers in SJ. I’m anxiously awaiting the opportunity to hear Baxter speak and answer a few of my questions.

responsibility to report budget items to the Board of Supervisors,
which is ultimately responsible for spending.
"Any employee using taxpayer funds in a way they should not be used needs to pay the consequences," Smith said.

This is a message from the Lovelace group of concerned citizens seeking justice and transparency in our county. We want to thank all of those individuals who assisted us in this latest investigation, the results of which you see below in the form of a set of questions. The citizens of this county require answers to these questions, and there is nothing requested that should not be made immediately available to the citizens. We will no longer stand for hidden agendas, collusion and demand the BOS and all those named in this report respond to the citizens of this county. We will give a brief overview of the situation we investigated, and then present a set of questions that must be answered by those parties requested. We the citizens of this county are taking the internal and external workings of our government back into our hands, you will respond to our requests and you will perform your duties according to our Sop’s not the ones you create for yourselves, but the ones the citizens demand. The report below is one of many on-going investigations, we will say again, this is only the beginning each and everyone of you in our local government are being looked at and watched, there will be no more hidden agendas.

As all of you are aware Garzoligate broke many months ago, and the reaction of the BOS and cover-up by the sheriffs department is at best terrible. During the course of this same timeframe, prior to the crash, another event unfolded, and was only very lightly touched by internal reports, some of you may have heard glimmers of this event but did not get the full story of those involved, and the set of events associated with this situation. Be aware that this report will be given to each of the BOS members and those in our county offices.

During the period that Garzoli was illegally flying, using taxpayer money for his own personal training sessions, another event occurred, in an area around the vicinity of the Cobb Mountain complex, Mr. Garzoli elected to give kiddie rides on the helicopter he was flying, this in an of itself is astounding and almost hard to imagine. The risk to the county makes the Dinius situation pale in comparison. We know as pure fact these illegal flights took place and that children were taken up in the helicopter on flights. We know that touch and go’s were done during the course of these activities and many flights were given to children. We know that some children were of known friends and some were family. We know that these flights took place using taxpayer money and that they were illegal. We know that Robbie Howe the second in command took pictures of these flights and had full knowledge of them. Here then are the questions we are asking and what our requirements for response are, this is information the public should already be aware of, and no individual can claim any reason for why this transparency has not happened, and the information not been given to the public, regardless of the “reviews” being conducted by the FAA/DEA/and AJ.
 

1. Mr. Howe why were you observing and participating in Garzoli’s illegal flights?
2. Mr Howe did you take pictures of the flights with the children?
3. Mr Howe did you stop Garzoli from taking these flights?
4. Mr Howe where are the pictures? Who were the pictures given to?
5. Mr. Howe why did you give this information to Rob Brown?
6. Mr. Howe did you wait a period of time before talking to Rob Brown?
7. Mr. Howe how long did you wait and why?
8. Mr. Howe why would you tell Rob Brown of these fun little flights?
9. Mr. Howe based you being a principle in these flights have been punished in any way?
10. What is Mitchells knowledge of these flights,?
11. Mr. Mitchell did you discipline Mr. Howe for his participation?
12. Mr. Brown did you report this incident and what is the accounting of that reporting.
13. To the board of supervisors, was all of this information provided to the FAA/DEA/AJ
14. To the BOS what is the connection of the DEA to this event?
15. Was anyone in the DEA aware of these flights?
16. Was there another individual flying with Garzoli during these flights?
17. Where any individuals who flew with Garzoli during these flights with the DEA?
18 Was the DEA aware of these flights during the days following them?
19. Kelly Cox, what role did you play in the reporting of these incidents?
20. Kelly Cox, Anita Grant, and the BOS, how many flights were taken, what it the cost of these flights, and who is responsible for those monies?
21. Do the citizens have an exact accounting down to the penny, of who is responsible and what the costs are.
22. What are the names of the parents of the children who were taken on these flights?
23. Are these Flights recorded in the flight Log books?
24. Has anyone looked at these log books and found these flights?
25. Mr. Brown was the conversation with Mr. Howe just a casual conversation?
26. What immediate action did you take Mr. Brown? What are those timelines who else did you talk to and for what purposes?
27. What members of the BOS are aware of these flights and the ramifications of them?
28. Why has this been covered up, and in total not reveled to the public in detail?
29. Mr.Brown who are your confidents either in local media or other sources, and why do you have such conversations?
30. Mr. Brown why when you communicate to the citizens do you cc news paper reporters in those communications?
31. Mr. Mitchell what discipline has been given to SO Howe?
32. Mr. Hopkins what is your knowledge of this situation?
33. Whose property did these flights take off and land at, we require full names and addresses of these locations?
34. To the BOS how often and when do you discuss citizen matters off the record and with which reporting agencies and why?

We are going to leave these questions as the first phase of our reporting of this incident. We demand the BOS and all other parties respond to these questions and immediately present them to the citizens. The times of cat and mouse are over, the citizens will not stand for any further hidden agenda’s and collusion. Even for those questions you have plausible answers to the question will still remain, why are the citizens not being informed. The questions we describe here are the manner and presentation of which transparency is developed and put forth to the citizens. We expect this level of reporting and communication to be the norm for the citizens of Lake County.
 

As long as they are being paid by the citizens they shouldn't be able to refer to them as Koolaid Drinkers.
 

Was Garzoli the pilot, flying without a licence with passengers on board?
 

Garzoli may have had a license for flights, but he would have had to purchase the extensive helicopter rental, fuel etc. We find this hard to imagine given the basic pay of Garzoli.We do not know if this is true that he has some form of a license for these flights, but the passenger issue is unknown even if he did, and paid the thousands of dollars for rental and fuel etc.
 

Meredith's contract with LCSO said, "The purpose will include but not
be limited to reconnaissance and eradication of illegal marijuana
gardens."
The company talked with Garzoli about flight issues, not the sheriff, Meredith said.
Meredith said with his permission Garzoli took his son up on a marijuana reconnaissance flight with another pilot.
 

Who was the "another pilot?"
 

Goodness! If this claim is true and correct, what in blazes can we expect Lovelace to uncover next. God help us all.

Indeed who was the other pilot in that single instance, and what is the lawsuit potential if a crash occured with the child in the copter, not a good idea by any stretch of the imagination.Was the other pilot a DEA agent?
 

We have
guys who we trained to use polygraphs and CVSA's who retire and make a
living with it, we train guys to get commercial drivers license who
retire and drive trucks, we send guys to armorer school and retire (or
outright quit) and open gun stores; hell they trained me as a forensic
computer examiner once(which cost more than a private pilot program at
most flight schools-is this fraud too?), which if I hadn't grown sick
and tired of looking at child pornography I could probably put to use
outside this line of work making more than I would as a pilot.
 

Post 6:40 that is the post of Garzoli from the helo forum on the internet, ahhhh how it all comes together, this is why we investigate and why the citizens must demand transparency.

My current paycheck averages $3800 if I work no overtime and
depending on the pay period could be as low as $3400. My next check
however due to having OT should be close to $6K. I am able to pick and
choose when I want the OT and when I don't, < Is that true of all SO or just a select few?>
 

Depending on the timing,if this claim of a children's joy ride occurred with the DEA grant monies this could explain another reason why Garzoli is on paid leave. What I don't understand is why hasn't he been fired? What is left to investigate if Brown did in fact receive this information? This information is enough to terminate. If Garzoli paid for the joy ride out of his own pocket and the joy ride occurred on his own time then I apologize.
 

Look at that statement about Garzoli's OT. Another mess that Mitchell did. Since Garzoli was such a kiss ass, he made a deal with the devil (Mitchell). If Garzoli volunteered to take a demotion, he would still keep his seniority. Well that is exactly what happened. Garzoli walked into the Sergeant's Office the next day proudly bragging that he has more seniority than anyone in Patrol second in the entire LCSO.

Mitchell, why would you do that? Garzoli creates a mess and a total embarrassment to LCSO and you allow him to keep his seniority? Also as a sergeant, he still supervises deputies and can do almost everything he did as a lieutenant. Great move Mitchell.

The internal Admin leave report on Garzoli lists this incident as one of the causes for his Admin leave, in fact it has been reported from inside that Mitchell would have let Garzoli slide if it was just the helo crash! But when it was all added up the risk to Mitchell of not putting him on Admin leave was to risky, they were able to cover up the kiddie rides a bit it appears. But many questions are pending as we have listed them. The post on Gaarzoli's pay he posted on the internet, is typical of the Overtime the BOS has not been tracking. This overtime is given to the GOB's only as in those on the drug task force, such as Santor in LPPD, he is another slippery one who should be looked at.
 

Garzoli and Perdock will be fired, you will never see them in uniform again in this county. We posted that fact yesterday.
 

If the BOS and County counsel were doing the Peoples business when they composed and sent the letters about the helicopter incident, Don't you think we are entitled to see a copy of the letters that were sent in our name and paid for by us?

McPherson: Fails to supervise the Range Masters resulting in the Wright incident.
Morshed: Has sex on duty with a fellow employee.
Martin: Shoots a dog in city limits with a bb gun.

I know what John Langen thought about the Dinius trial. He told Hophead to drop the case. Dinius shouldn't have been charged. Instead John Langen was dropped and Hophead took the case personally. I heard it from his own mouth. To the Dinius lawyers, Contact Lovelace by G-mail, they know who I am. I will be there to testify.

Your right on Langen, Hopkins tried to slip by on that one by saying "He left for more money" You see this is the trickery of a guy like this, sure he got more money where he went, anything is going to pay more then LC DA position. The DSA will not endorsing any candidate for sheriff. They probably will endorse a candidate for DA (not guaranteed yet), but at the moment that is up in the air except for the assurance it won't be Hopkins. They are not happy with Hoppy. This is from the inside. When the DSA endorses a candidate, you'll know soon enough. As for the officers associations with the LPD or CPD, no one knows other than neither will be endorsing a sheriff's candidate, as it sits right now (lots of division).
 

A few years back I was railroaded into jail for some minor offenses. I served my time so say what you like. While I was there I worked on the road crew. One day we were ordered to work on a private driveway for one of Rob Brown's friends. We fixed all the potholes and delivered several loads of gravel in county trucks. It was off Bell Hill rd. Try to deny it if you want Rob, but remember, There is no honor among theives.

Remember the supposedly fake DEA raid in Clearlake Oaks this summer? They all had DEA jumpsuits on. They all had M-16's. They all had DEA vans. Where do you get that stuff. What Hopkins didn't say during the radio interview was that there was a deputy DA who reviewed the case and filed the charges. He's the one who left. He never even appeared on it, so far as court records show. Then DA Langen took it over, as it was handed to him to do by Hopkins. After several months of fretting, he decided it was a loser and wasn't ready to go forward on it. A couple weeks short of trial, he wanted to get out of it completely, and threatened to quit if he wasn't allowed to get out. Hopkins then took over the case, and rather than reviewing it himself, plowed forward without a thorough review. Thus he's technically correct about taking it on a few weeks before trial, and thoroughly pumping smoke in trying to make it sound like the wheels were in motion and he just "stepped in" to handle it, when it could have been short-circuited then if an "experienced prosecutor" had actually independently reviewed it, and decdied whether it was worth going for or not. Hopkins can't blame anyone but himself for that catastrophe, and trying to dump it on another one of his employees is just plain lame. Who else can he find to throw under the bus? At that rate, he'll run out of boss fodder soon enough....

Jones until Jones gave up and stepped down to sergeant. How about Ostini? As a lieutenant, Ostini was a by the book person (as now). He made one mistake that deserved punishment, but demotion was not it. Markham and Fry did worse and only got a reprimand. Since Ostini did not support Mitchell during his run for sheriff, Mitchell looked for anything to get back at Ostini. When Ostini made a mistake, he was demoted, not fairly disciplined. Than you got Beland. His testimony was never questioned by anyone in the DA's Office, judge or defense. In fact, he provided additional information the DA's Office did not have until trial. Look what happened to him. Now Morshed (who helped Mitchell on his election). After his unprofessional conduct he was only suspended but if you look at Ostini you will see transparency is not in Mitchell's vocabulary.
 

No, if a deputy is involved in an officer involved shooting, we have had a few where the deputy did not go on Admin Leave.

2. Yes, if you read the reports, there were four bystanders that said the lights were on. Also, both Expert witnesses could not agree on if the lights were on or off. There glass was not broken on the boat that would show a unique cause. The boat was moved and docked overnight with nobody to watch it and of course the jury found Dinis not guilty.

During the period that Garzoli was illegally flying, using taxpayer money for his own personal training sessions, another event occurred, in an area around the vicinity of the Cobb Mountain complex, Mr. Garzoli elected to give kiddie rides on the helicopter he was flying, this in an of itself is astounding and almost hard to imagine. The risk to the county makes the Dinius situation pale in comparison. We know as pure fact these illegal flights took place and that children were taken up in the helicopter on flights. We know that touch and go’s were done during the course of these activities and many flights were given to children. We know that some children were of known friends and some were family. We know that these flights took place using taxpayer money and that they were illegal. We know that Robbie Howe the second in command took pictures of these flights and had full knowledge of them. Here then are the questions we are asking and what our requirements for response are, this is information the public should already be aware of, and no individual can claim any reason for why this transparency has not happened, and the information not been given to the public, regardless of the “reviews” being conducted by the FAA/DEA/and AJ.

Yes I agree, Steve Jones was a good man and I enjoyed working for him. He had a fatherly/mentor type of personality when supervising young deputies and he was easy going to the senior deputies. As I said before, when Steve and Ostini were lieutenant's, they and the rest of management opposed Mitchell as Sheriff. Once Mitchell became Sheriff, he targeted both. Steve got so upset over the harassment that he took a reduction to sergeant. Ostini was in the jail and said a racial slur that got him in trouble that he had never done before or since. Nobody disagrees that Ostini should have been disciplined. Instead of a Letter of Discussion, Letter of Reprimand or suspension Mitchell demoted him. Ostini did not fight Mitchell, just went on to be a very respected sergeant with LCSO. Compare that with Markham, Garzoli or Morshed's conduct.

Steve Jones and Dennis ostini are the pictures on Professional Law Enforcement. The statement that Ostini made was a common occurs within the jail. Little war hero Frank G., Sgt. C. Esburg set him up. Little Franky just got fired and is currently unemployed, than Sgt. Esburg is now a Captain. One more reason not to vote for Mitchell.

Most of Mitchell's Command Staff are pieces of human waste, along with Mitchell himself. No we the tax payers will pay a ton of money for Mitchell mistakes that he allowed to happen.

for their own lack of self reliance. The want ads in our newspaper is
filled with jobs and because of their race are eligible for minority
preference in hiring!!!!!!! There is no reason for casinos unless they
are going to pay substantial taxes to the local government and or it is
legal for anyone wanting to open a casino. One more thing. I know from
first hand experience, that with the three casinos in my county, the
biggest problems the casinos have is keeping the native americans that
work there and that live on the rancherias from stealing them blind!
Local law enforcment is constantly investigating dealers cheating with
other tribal memebers, embezlling money etc. They should just get a
real job, for they are not struggling becasue of their race they are
struggling because of their personal work ethics values

Ostini's little mistake was using a racial epithet in front of minority...Isn't that the exact same thing Rivero is accusing so many of the other deputies of doing? Actually there's a subtle difference in that Ostini's comment was mean spirited whereas the other "racial" comments were not meant to be hurtful.

Steve Jones was a nice man, but he was lacking in his ability to be flexible and was unable to keep up with the changes in case law and supervision methods.

Had Ostini not been demoted for his comments, you all would be using that against Mitchell today.

2010 8:06 AM Ostini did a mistake and he admitted to it. He never tried to make an excuse and that is why he took the demotion and not fight it. Now, compare that to Garzoli's sexist activity, who got NO disciplinary action. Morshed, who had sex on duty as a sergeant only got a suspension. Markham, who got no disciplinary action and Fry, who pinned a female deputy against the wall got no disciplinary action. During court, Fry said females have no place in law enforcement.

What most do not know is that Ostini had just taken over the Boat Patrol. You are right, he had no experience and that is why they sent him to navigational school. Ostini never lied, was never accused of a lie nor did anyone including the DA, Deputy DA, defense or judge even in the slightest way ever state Ostini's testimony was untruthful (just like Beland).

Ostini is a fine supervisor and you won't find a deputy who doesn't respect him. He is fair and by the book. Can't say that about Mitchell, Brown, Hall or Bauman.

Did anyone else notice that nobody has come to defend Garzoli on this site? We have had bloggers defend Mitchell, Ostini, Beland and even Perdock, but nobody came to the aide of Garzoli. Does't this tell you something Mitchell? Garzoli was not respected by anyone at LCSO (well maybe Macedo). Mitchell promoted him from deputy all the way to lieutenant and than back to sergeant. Than Mitchell allows him to keep his seniority. What an example of incompetence.

We want to thank all of those individuals who assisted us in this latest investigation, the results of which you see below in the form of a set of questions. The citizens of this county require answers to these questions, and there is nothing requested that should not be made immediately available to the citizens. We will no longer stand for hidden agendas, collusion and demand the BOS and all those named in this report respond to the citizens of this county. As all of you are aware Garzoligate broke many months ago, and the reaction of the BOS and cover-up by the sheriffs department is at best terrible. During the course of this same timeframe, prior to the crash, another event unfolded, and was only very lightly touched by internal reports, some of you may have heard glimmers of this event but did not get the full story of those involved, and the set of events associated with this situation. Be aware that this report will be given to each of the BOS members and those in our county offices.

During the period that Garzoli was illegally flying, using taxpayer money for his own personal training sessions, another event occurred, in an area around the vicinity of the Cobb Mountain complex, Mr. Garzoli elected to give kiddie rides on the helicopter he was flying, this in an of itself is astounding and almost hard to imagine. The risk to the county makes the Dinius situation pale in comparison. We know as pure fact these illegal flights took place and that children were taken up in the helicopter on flights. We know that touch and go’s were done during the course of these activities and many flights were given to children. We know that some children were of known friends and some were family. We know that these flights took place using taxpayer money and that they were illegal. We know that Robbie Howe the second in command took pictures of these flights and had full knowledge of them. Here then are the questions we are asking and what our requirements for response are, this is information the public should already be aware of, and no individual can claim any reason for why this transparency has not happened, and the information not been given to the public, regardless of the “reviews” being conducted by the FAA/DEA/and AJ.

INCIDENT RESPONSE AND INVESTIGATION:

Saturday, 4/29/06 at about 9:45 PM, my central dispatch staff phoned my home to notify me of the boating collision. This is standard procedure in the event of a major incident. I was told that there were serious injuries involved, there were possibly people still unaccounted for in the water, and that Russ Perdock was driving one of the boats involved.

Saturday, 4/29/06, at 10:23 P.M., I arrived at Bayshore Marine. Sgt. Dennis Ostini briefed me on the circumstances as he believed them to be at that time. We discussed bringing in an outside investigator and initiating the local critical incident protocol (see question #18 for further details).

I contacted Russ Perdock at the scene. I did not detect an odor of alcoholic beverage on his person and I made this observation at close range when I embraced him. Perdock twice expressed a desire to be taken to the hospital for a blood draw as quickly as possible to avoid the possibility of any allegations being made later that his blood alcohol readings were altered in any way because of delays.

12. Mr. Brown did you report this incident and what is the accounting of that reporting.
13. To the board of supervisors, was all of this information provided to the FAA/DEA/AJ
14. To the BOS what is the connection of the DEA to this event?
15. Was anyone in the DEA aware of these flights?
16. Was there another individual flying with Garzoli during these flights?
17. Where any individuals who flew with Garzoli during these flights with the DEA?
18 Was the DEA aware of these flights during the days following them?
19. Kelly Cox, what role did you play in the reporting of these incidents?
20. Kelly Cox, Anita Grant, and the BOS, how many flights were taken, what it the cost of these flights, and who is responsible for those monies?
21. Do the citizens have an exact accounting down to the penny, of who is responsible and what the costs are.
22. What are the names of the parents of the children who were taken on these flights?
23. Are these Flights recorded in the flight Log books?
24. Has anyone looked at these log books and found these flights?
25. Mr. Brown was the conversation with Mr. Howe just a casual conversation?
26. What immediate action did you take Mr. Brown? What are those timelines who else did you talk to and for what purposes?
27. What members of the BOS are aware of these flights and the ramifications of them?
28. Why has this been covered up, and in total not reveled to the public in detail?
29. Mr.Brown who are your confidents either in local media or other sources, and why do you have such conversations?
30. Mr. Brown why when you communicate to the citizens do you cc news paper reporters in those communications?
31. Mr. Mitchell what discipline has been given to SO Howe?
32. Mr. Hopkins what is your knowledge of this situation?
33. Whose property did these flights take off and land at, we require full names and addresses of these locations?
34. To the BOS how often and when do you discuss citizen matters off the record and with which reporting agencies and why?

We are going to leave these questions as the first phase of our reporting of this incident. We demand the BOS and all other parties respond to these questions and immediately present them to the citizens. The times of cat and mouse are over, the citizens will not stand for any further hidden agenda’s and collusion. Even for those questions you have plausible answers to the question will still remain, why are the citizens not being informed. The questions we describe here are the manner and presentation of which transparency is developed and put forth to the citizens. We expect this level of reporting and communication to be the norm for the citizens of Lake County.

Interesting little note, Jeff Smith was at Rivero's meeting last night, one of our group saw him, and he has been at a couple of Rivero functions. Doesn't say anything, nor applaude, but just watches, what are your thoughts on this, we would like some input on if he is a "mole" does anyone think he has some connection with Mitchell and is tracking Rivero?
 

I have been to three other meetings of officer Rivero and have not seen him there. I would be disappointed if officer Rivero has anything to go with that low life.
 

Webster's Dictionary defines perjury as, "the voluntary violation of an oath or vow either by swearing to what is untrue or by omission to do what has been promised under oath: false swearing." Ostini told what he thought to be the truth. Before you start accusing someone of a crime, maybe you should look it up in the penal code and also in the dictionary.

I think both Baxter and Rivero are committed to the long haul. I question if McCarthy can do anything but help Mitchell. Brian Martin is just another example of a sheriff's office turned rogue with deputies who think they are above the law and bosses who ignore or condone their actions. What does that say about Mitchell and his staff, the control they are exercising over their people and the negative example they send. Forget Martin and all these other dopes and lets stay on the guy in charge. These people will take care of themselves once Mitchell is gone. That must be our priority to rid Lake County of an incompetant and crooked sheriff and DA.
 

Lovelace here, we suspect Marty is already out of the race, we think he tested the waters to see if after so many years the past would not come back to haunt him. We had several conversations with him and gave him our opinion on his chances and clearly stated the issues he would have to overcome, that posting is on our site several pages back. We suspect he has decided not to continue. That leaves 3 in the race, at worst case there would be a run-off between Mitchell and either Rivero or Baxter. Rivero currently has a distinct advantage in that he is doing a great deal of work knocking on doors, hundreds and hundreds of doors already, this is something Mitchell cannot do,(as he could get really hammered), so he can only hope his "base" is intact, however we have defined plans to attack that base, and a whole set of plans surrounding this aspect of the election. A runoff, would give more time to hammer Mitchell and allow the Dinius trial to bring up all the dirt. Frankly we have so much more coming Mitchells way, we are not sure at this point if he can even make it into the runoff, it could end up Rivero and Baxter. Baxter has a long way to go at this point, he is going to really have to play catch up. And he is going to have to be able to sustain it for the long haul, time will tell on that.

Lovelace, I spoke to you on the phone a few minutes ago so you know it's me. I want to clear up the Ostini controversy. I've personaly known Dennis for many years. It would be hard to find a better cop anywhere. As I've said before, he went to boats to get away from the Mitchell crap, (although he would never say that) He has had run ins with Mitchell but he has always done his job outstandingly. He would not lie to anyone about anything, period. There's not enough men like that left today.
Take for example the ex-CO, ex-LPPD, ex-task force, demoted back to LPPD, (for lying on a police report), resigned (fired) from LPPD, and fired from Robinson Casino, The liar Frank Gudmunson, the guy who started Ostini's problem in the first place. I'd have to believe Ostini on that one too.

I think Frank Gudmunson is a big lair too. He does not look black because he is only 1/4...one of his brother's "nick names" is "buckwheat" and everyone calls him that. He claims he was let go from LPPD because he shared a "family" momment with a female at LPPD. He states he told this woman what his father would say to him and his brothers when he was mad at them. It involved the "N" word. He claims that was the reason for his discharge from LPPD, others claim it was over steriods.

Well it's great to see so many Ostini supporters. As I've said before, Mitchell's form of discipline depends on your loyalty. Garzoli has been a sexist ever since I could remember. Making sexist remarks to civilian staff to hanging a photo of his wife drooling over a clam on his wall. What did Garzoli get? NOTHING!!! When Perdock lied to investigators what happened to him? NOTHING!!! When Morshed has sex while on duty what happened to him? Only a suspension.

Ostini made one comment and yes it cost LCSO. Ostini never made up any type of excuse took all the blame and said it would never happen again AND IT DIDN'T. Frank told me later that he didn't want to file a suit, but was forced to because Crystal Esberg wouldn't let him talk to Ostini.

When a sheriffs deputy is accused of wrong doing or a policy violation or just crossing Rodney are they afforded their rights under the Peace officer's Bill of Rights? We see some people being demoted for fired at the blink of an eye. Do they take time to investigate the incident or consider even cops are innocent until proven guilty. Are they given a notice of intent to discipline or a Scully Hearing with the boss or just punished. Hoe can the sheriff move so fast in some cases while moving so slow in others?

You all think the BOS has no oversight and has not, well we think Robby the cowboy Brown has been well aware of SO's doing double duty, and a lot of other supervisors as well, they are only in charge of the money, but sure haven't been on that have they.
 

Well the biggest issue with Mitchell has always balanced discipline he has done a terrible job of this and people are going to get their jobs back because of it. He has dug one hell of a hole, and he aint climbing out of this one. Bring the dozer in, cover that hole up and lets build a new house on that spot.

OMG, I was presented with a tee shirt tonight for Lovelace...it is beautiful! My daughter went online etc. They are cool! The computer most likely will go to Napa where there is a computer forensic team. This is the same team that Garzoli used to belong too.

What I hope is that it shows nothing. Then Morshed, with his EEOC complaint, will have even more ammo to sue the shit out of Mitchell. So what would the score be on that? Lets see.

Train Garzoli in computer forensics on our dime. Let Garzoli take Helicopter training on our dime? No wonder they call him Mitchell's golden boy. How much did the computer training cost us? Garzoli did say it cost more than Helicopter training. We have a lot invested in Garzoli with no return. How many others are there?
