The question still remains how a correctional officer making 3000 to around 3800 gross a month lives and maintains a ranch and horses of that level, he has a web page of the ranch etc. we are not so concerned of how he came across the property, family etc. but who is banking all the cash for the horses the feed etc. Now we do not know what this amount is nor what his wife does, so maybe there is a good explaination...anyone got one?

Somebody had asked what Rusty's wife did for a living. She was a probation officer here locally and I heard she resigned rather abruptly not too long ago.

Is that also the reason you have not hired any African American in your employment policy under the Mitchell regime the past 11 years? Is that also the reason you don't like to hire many local applicants, as your records will show? Did you or did you not have to pay a judge order fine of $2000.00 to Mr. N. Green for violating his freedom of Speech rights when he displayed a sign on Main Street, Lakeport, which said that Sheriff Mitchell sucks? By the way do you still owe that $2000.00 to Chief Engstrom, Lakeport P.D.? Are you also the reason for his early retirement? Did you or did you not release an elderly Lake County resident from the local jail with an 0.08 alcohol level which resulted in a major tragedy just minutes and a few 100 yards away from jail after his release? I am wondering in what folder you are going to file that tragic incident. Under justice terms, using the words: tragedy or involuntary manslaughter, negligent homicide or perhaps premeditated murder? Knowing that you settled this case, how many millions was it for? Who is going to pay this blunder, you or the L.C. Taxpayers? By the way, was there a press release about the settlement? Did you or did you not use the biggest bulldozer available in Lake County to push dirt under the rug created by a sergeant in the Sheriff Dept. last summer at the jail?

Did you or did you not fire that sergeant and then after 3 weeks retire him? By the way Sheriff, if a guard is having sex with an inmate, I believe some laws are being broken. See your second mission statement which you call code of ethics, you should really study and practice it more especially by enforcing and obeying the laws. Your first mission statement where you promised sound hiring practice really sucked. You constantly hire from out of county. Did you or did you not want to see the reason for the many complaints, law suits and plenty of violations also cited 32 times by the Grand Jury 2003 and many times in the past 11 years at the jail created by your two Lake County house wife in charge of the operation at Abu Ghraib by the Hill Road County jail Chief Commander Eyerly and Sergeant Rosemary Townsend better known as “Rosie” to you. Both of them have no post certificate and are trying to run a professional division of the Justice system.

For damage control, of course, you have to deny everything it is written in the politician guideline book. Also look up Grand Jury 2003 final report under your conclusion and use the same wording such as accusation, bigoted, malicious, self serving, unscrupulous accuser, libelous and slanderous.

I believe we should not be looking at Rusty. He has been caught and arrested (finally). LCSO recovered stolen property and now he will answer for it in court. His financial income has no relevance to this case. He's a high ranking NCO in the ANG, a senior CO and his wife was a Probation Officer.

We really need to look at three majors flaws that were most likely Mitchell and his management's fault.

1. How was Rusty allowed to go on Admin Leave and the range keys were not recovered?

2. How is it that an arrest warrant was issued the same day this incident went to the press? It was filed as a complaint and usually takes several weeks to get a warrant (unless you walk it through)?

3. If the taser and handcuffs were recovered, why was an arrest not made on the spot?

Sounds like an all American healthy young man, that grew up in an America that he is proud of. When our Military men and women come home, what will it be like? Will they too have a collection of guns? That they live and die with each day, these are young adults, and this weapon they carry is their security. Why do so many get uptight about porn? Mitchie isn't trying to throw the election, he was trying to keep the Rusty thing low profile...so as NOT to blow the election. Alas, he got caught. 9:51 - Dennis may be a good guy, but from where I was sitting in the courtroom while the Dinius trial was going on, Dennis sat glued to Hopkins Hip. Was smug about the proceedings and lied. When Dennis first took over boat patrol he sat at a BOS meeting about boating safety, also made a clip on it that TV 8 always showed. Statement made at that time when asked, how fast at night would you say one should travel by boat. Answer, 5-10 mph. And, he also stated, Going out at night on a emergency call, thats the highest rate of speed that he would do because it is not safe at anytime on the waters. Then at trial he states, 20-25 mph. So, what is it? Ostini is a whimp and is a follower, no leader and has no business being in boat patrol, and left to do a investigation, or control any given situation!
 

Just for those of you that live in an alternate universe, here are the cold, hard, facts. LE attracts horndogs, like flies to crap.The opportunities are just too darned good to pass up. The most common currency on the street, is the worlds oldest commodity. The old saw that says, "Ya got it, Ya sell it, and ya still got" is the rule of the streets. A parking ticket at the wrong time, and place, can lead a suspect to make an offer. Thats just too good of an opportunity for most LE folks to pass up.
If you doubt me, just look at the wives of the LE people in any of the county agencies. They look like the Stepford wives of boob jobs. I suspect they get a fleet rate. The competition to outshine the freelancers on the street must be vicious.

Can someone please inform me how a correctional officer (Captain Esburg) can be placed in a position over deputies? She was a jailer and a dispatcher, but NEVER a full time peace officer. Why was she taken out of the jail in the first place and replaced with a full time peace officer? Mitchell, are you next going to take a dispatch supervisor and put him in charge of the jail? Or maybe take a Correctional Officer and put him in charge of Patrol?

Facts: The Ranch that Rusty lives at belongs to his wife, it is on Wight Way not Wright Rd. It has been in HER family for generations. Many people own horses and are perfectly capable of taking care of them without stealing. I am a single woman who has 5 horses of my own, so only one income coming in and I have no trouble what so ever taking care of my horses, so you insinuating that the Wrights with two incomes must be doing someing wrong in order to afford their horses is just ridiculous. I feel sorry for this family, all this talk with no proof and no conviction could just be ruining the life of a nice guy. What ever happened to INNOCENT until PROVEN guilty? I for one will be waiting to make judgment until the evidence and testimony come out in court, because so far this looks like someone who was throw under the bus to get eyes looking somewhere else.

How can we keep overlooking Mitchell's mistakes, poor management and out of control supervisors. We have a supervisor who crashed a car at 100MPH just to get home early, driving like a nut on the water causing the death of another cop, crashing a helicopter, forgetting to recover the keys to the armory, racial misconduct and retaliation. LE Management here under R. Mitchell and the DA in lake county has never been one of abiding in the "innocent until proven guilty law"....history shows this; my family is one of many that has experienced this. That is the mentality that has been handed down to everyone. You would think that a good lawsuit would end this horrific mentality. Just look at the condition of the jail..the inmates are treated as though they are guilty even before they have a trial......no windows, no fresh air, no working toilets; sometimes no heat for days and more unacceptable conditions by state standards. Mitchell enjoys see people live this way....he gets off on it; His jail is really a prison atmosphere; for pre-trial folks. This is illegal.This is cruel and unusual punishment. So that mentality carries over onto everyone else.in law.....We are above the law, we are the jury, we are the Judge, no need for trial, we have plans for you, buddy; and we know how you should plead,too!
 

One day in mid 2009 I picked up a young woman, approx 25 yrs old with dirty blond hair and a tatoo of her daughters name on her left breast. She was about 5'7" and 150 lbs, the woman was mentally disturbed woman. This became apparent as I drove her to lucerne and we briefly spoke. She was first seen hitchiking at kits corners towards lower lake. I Later picked her up at tower mart going towards lucerne. I think she was Probably schitzophrenic becuase she didn't want to talk much and would just laugh out loud for no reason. However, she could say coherent things on occasion. She was just out of the lake county jail from the previous night. She did say she was in love with officer ..... and was very giggly about it. I wouldn't be suprised if officer ..... thought he could get away with screwing the young female inmate since she was mentally challanged. Be interested to see if anything comes of this very suspicious circumstance, or the officer gets away with this one...

very obvious lake county has grossly corrupt law enforcement in my short stay here.....

This is the Bureau of Narcotics Enforcement....They we have been told are an autonomus organization not connected to the Feds or other agencies, and we are told they would look into Sheriff's or other police personnel dealing in or having possesion of illegal drugs, gotten of course by various means. The captain involved in the death while operating a boat was Perdock (The Bismark Dinius case). The fatality was an off duty Alcoholic & Beverage Commission agent.
 

Lovelace, the female defending Rusty is allowed her opinion. Rusty was a nice guy, served honorably and hardly ever offended anyone. I think it was okay for her to come forward to defend a friend. Having said that, Rusty did wrong and overstepped his trust LCSO gave him. He trained and worked shoulder to shoulder with LCSO deputies and CO's. To break that trust should result in swift and harsh action, not allowed to just be placed on Admin Leave.

This is why I questioned no arrest when they found stolen property at his residence. Than a warrant was issued just a few hours after your story hits the news. The biggest mess was Brown and Howe. Instead of verifying Rusty turned in his armory keys when he was placed on Admin Leave, he was allowed to leave. Than they had to go Rusty's house to get the keys back.

Hello,I am a 24 yr old mexican/native american who grew up in lake county. You can see my picture hanging up in the courthouse with all of the other Lake County Veterans of War. It has been a struggle for me since returning home from my second tour in Iraq, but nothing has bothered me more than the news report on the sheriffs that are supposed to be protecting my community, my home. But then i remembered... being a kid and everytime we would pass a lake county sheriff they would put there orange lights on my dad. He would always say, "Watch son, there gunna do it again." Sure enough.. the lights flashed sometimes even before they passed. He said that a deputy told him that "they" had there eyes on him. When i asked him why, my dad had told me that he doesnt know why, but when he came from San Jose in the early 80's they would pull him over just to ask what he was doing there. Thinking back i can remember incedents such as this and its time for a change. We are a proud patriotic family, a Veteran of the Vietnam War who lost his leg there, and a two-time Veteran of the War on Terrorism... who knew that i would have to continue the war on terrorism when i got back home??? How can i help???

Second, you handling of the Bismark Dinius case. You have no problem with Mitchell interfering in the boating investigation, firing Beland just for testifying (can't wait to see that in court), Allowing Perdock's mechanic access to the boat barn, hugging Perdock at the scene, than brushing off the grieving occupants in the other boat and than you fail to lock down the case so that unauthorized persons (like Perdock) can't read it.

Third, your handling of Garzoli. You have been in his office numerous times, how could you not see the provocative photo of his wife on the wall. You see him wearing the flight suit, but state you did not know he was operating the helicopter. It has "PILOT" printed one it! You allow him to write the DEA grant, but failed to have a captain or even you review it before submitting it.

Fourth, you handed the racial profiling by using the county website, but fail to just come forward and state what the EEOC findings were.

Now you have the Rusty Wright mess. Failed to obtain a warrant until it hit the paper.

Curran volunteered for that position and takes his job seriously for over 12 years. In the office we nick named him The "Curminator". If you a sex offender, he'll do everything he can to get you. I've seen him make 40 year old body builders cry like a baby without touching the guy.

If you are ever the victim of a sex crime or your child is, this is the guy you want investigating it.

The board of supervisors could vote a no confidences but would have no bearing on their status quo. That would take guts, which there is a short supply of. The alternative at this point is officer Rivero or Mitchell. It is to trust Officer Rivero, hoping he is the answer or Mitchell the know incompetent. I choose Officer Rivero.

He promotes captains with little experience, allows them to interfere with investigations, has off duty conduct that brings shame onto the department and can't even gather controlled property when putting someone on Admin Leave. Well maybe the Lieutenant's are better. They only post provocative photo's of their wife on the office wall, write grants to help himself, operate a helicopter without permission, crash a patrol car at 100MPH just to get home early causing serious injuries to his passenger and get so drunk off duty that they pass out in front a deputy's house. Well at least we have good sergeants. You know they only fail to supervise people at the range, make racial slurs and sit in the office watching TV all night.

I've been attempting to put all the events of the "fallen from grace" deputies into perspective. My question is for a current member of the Sheriff's Dept. What is the percentage, in your view, of the remaining deputies that will eventually come under fire?
 

I see a lot of posts that support Frank Rivero, so I have a few things for you folks to consider. What part of San Francisco politics do we want for our county? Why would someone that has sold a couple of mortuaries for a lot of money, and won a settlement from the city of San Francisco, want to be the sheriff of some little backwater place like Lake County? Will Frank drop his pending legal action with Lake County if he is elected?
Remember boys, and girls, the most reviled, untrusted, people on the planet, are politicians, and used car salesmen, and morticians fleece these folks on a regular basis.
Why won't somebody worthy of our trust, and support, run for this office? Do they know something that we don't know? Or, are that scared of the machine?

O.K., I didn't think I would have to make this a Poli-Sci lesson, with this group, but here it goes. There are a couple of ways to control elections. One is to strong arm the people, stuff ballet boxes, import voters, register the dead, and scare people away from the polls ( this is the Chicago matrix). The other way is the California method, where you control who gets on the ballot, as best you can, and allow the people to think they are getting a choice, when they are really getting the same old thing with a new paint job. Does any of this sound familiar? Oh, and if you think this is all contained in this little county you need a big reality check.
 

Those that would make a fine sheriff, are scared to death, that the heavy hitters, that are keeping a low profile, will find some way to ruin their lives, like they have so many others lately. I can't blame them. I probably wouldn't run either.
 

post 9:10: So if no one shows up other then officer Rivero what would you do? I have only two to choose from. To this stage it has to be Officer Rivero.
 

Response to Frank Rivero support. Here is what I think and if you want it from Frank himself, go to Middletown and ask him yourself.

1. SFPD politics has a board of citizen's that oversee the department. That is what we need.
2. He owned and built those mortuaries to the second largest in the bay area. He had several employees and you don't hear anything bad about them.
3. This shows that Rivero stands up to illegal politicians. It was a 15 year court battle he won and how much do you think the lawyers got.
4. Frank retired in Lake County just like several other SPFD officers, a sergeant and a captain did. Clean air and no heavy traffic. That sergeant works part time for LCSO and the Captain was on boats, but retired about three years ago.
5. Now that he had no work, he wanted to do something and he liked being a cop so he joined LCSO. He saw the miss justice under Mitchell's management and wants to clean it up.
6. His EEOC complaint "might" be dropped because he can now order a fair investigation.

Why don't someone else run? First look at Mitchell's history of retaliation on anyone bringing him bad press. He fired Beland and only took Perdock and Garzoli out of action after major public outcry. Now he found out the Wright report was released and is looking to get that person.


Elect Rivero and see management run. Elect Mitchell and the mismanagement continues.

Many of these recent charges, even if not proven, will ruin the reputation of the officer involved. Thats all it takes. THEY DON"T HAVE TO PROVE SQUAT! Its like the old question "are you still beating your wife". Somebody on the inside has a lot riding on this election, and they are throwing everything but the kitchen sink into it, to muddy up the water.
 

A new Sheriff is needed to put the LCSO back on the right course. After years and years of mismanagement by Mitchell and his crew. The Department lack public trust. We can't trust some of the Deputies and none in management of the Sheriff Dept. Law Enforcement officers locked out the public in the debate in Kelseyville and someday they will asks us the Public to support them for some reason, They have nothing coming from us, the Public. Mitchell needs to come clean and clear the smoke from the fires he started. Public trust is what law enforcement is ALL ABOUT. How can we trust Mitchell to head Sheriff's Dept. anymore. It's time for a new sheriff that will build trust with the public and get Deputies out of the office and onto the Streets doing there job. Protecting the Public and building trust.

I understand you comment and could not agree more. The public needs someone to bring LCSO back into the 21st century. Let the public know about the EEOC findings and take harsh actions against managers who used their position for retaliation or personal gain.

It set new case law concerning suing public employees which will no doubt help Dinius in his upcoming suit.

I worked with Russ for 10 years and have known him for longer. He is a good person and I don't think he stole anything. There are no procedures for checking equipment except firearms. The public needs to know he was not fired for anything to do with porn, but he did not file paper work as directed. They also need to know that the COs are not stepping up because they are scared for there own jobs. The staffing has been short for a long time. A good CO is always running and Russ covered my back lots of times. At the doing of Admin, the jail has been run for a long time by Deputys, not CO's, who make no bones that they don’t want to be at the jail and are above it. The moral is low and it seemed like a morgue when Wright was brought in. Most of the CO's think its bullshit, but are afraid to say anything. It's easy to throw a CO under the bus, in this Dept. they are not worthy anyway. Why else would Deputy’s under investigation or demoted be placed in the jail to manage and work?? This is a dirty department
 

You guys need a new leader.......don't you see that.....You are all pawns, and that is all...you guys deserve more; Your Jobs are very important and it is important also that the citizens who are arrested; whether guilty or not; which is to be determined
should not be treated unconstitutionally.... You guys deserve a Leader who is present; not someone hiding behind his desk.

Use the G mail if you have information that will help him. There are two sides to every story. Thanks to this group you can help tell his side. Everyone needs a friend that will support them, maybe you are that friend?

Can anyone explain all of the demotions in the department over the last several years?
Why promote so many people only to demote them a short time later?
I have not met Frank Rivero (yet) but I intend to do so, because I absolutely cannot vote for Mitchell. I hope that Rivero can persuade me to give him my vote.
 

I heard from some friends this same story. When Rusty was brought in it was like a morgue and lots of people were crying. They know Rusty was thrown under the bus by mitchell to save his own butt. People are scared to say anything at the jail but you know that alot of them can't stand mitchell anymore! What a screwed up place to work that the employees have to be afraid of that crazy mitchell everyday. It is time for mitchell to go we have seen enough!
 

I think the best part is Hopkins thinks that no one is watching him. LOL
 

Lets get something right, Rusty was not "brought" in to the jail. He was hired just like everyone else as a CO. He tested for deputy, sent to the academy but failed his field training. He was offered his job back at the jail and he took it. He was by no means "Brought in". The jail being like a morgue is true, but that changed with Basor and Howe taking over and kicking Esburg back to the sheriff's office.

Rusty was caught stealing and now has to pay the price. I want to know is why Rusty was not arrested when the gear was found? And why is it that the warrant was only issued after the news story.
 

12:44, I think what 11:35 meant was when Rusty was brought in and "booked" a lot of the CO's on duty were very upset etc.

As per the Record Bee, Mitchell has on Weds. opened a investigation in to who accessed the RiMs and copied the roports on Wright. Question: Does this mean Liz Larson/Lakeconews is in trouble and Mitchell is trying to go after her or is he going after Lovelace or after both?

I don't think we have anyone who is currently working for LCSO that ius qualified to be a LE administrator. Not to say that in the future there isn't someone in the ranks who can grow and become a qualified leader. The current LCSO brass is a joke and needs to be retrained or purged. Mitchell needs to go back to sorting boxes.
 

I ask again, what's all this Dutra this and Dutra that. He's not squat and damn sure noty runing for office.
 

Let's see how that works, Rodney wants to do a "witch hunt/investigation?" The first thing he does is announce his plan to the press? Does Rodney think he needs the public's help? If Rodney thinks that he has the public behind him, He better stay out of the evidence room. You can get a contact high from just opening the door.

I was not trying to twist the truth, I thought you were talking about when he started working in the jail. In that case, yep it was like a morgue and I hated to see a good person go bad. But Rusty himself gave consent to look into the bag. He had stolen county property and this is the result.
 

Yep 1:56 you said it, dutra ain't squat. But his daddy-in-law rhoades is running for a public office so that makes dutra and the wife fair game. You know the old saying: tell me who your friends/family are and I'll tell ya who you are.
 

I tend to disagree with you, post Feb. 5, 1:48 pm. There are a couple of people that are qualified. One of them is running for sheriff. His name is Francsco Rivero. This will sound like a broken record, but, he has eight years as a cop in a large department (SFPD.) Not just as a street cop but as a narcotics officer and a detective. He also has three years with the LCSO as a street cop and an interim supervisor. He has fifteen plus years as an adminstrator running a very successful private business. Also, as the sheriff you are also the coroner. Mr. Rivero is well versed in the legal side of the coroner's duties and responsiblities. Not just because of his current employment, but also because of his vast knowledge in that field due to being in the funeral business.
 

2:10, how do you know he wasn't getting ready to return it to the SO. Why would he have it in his truck where it could be discovered by any LE agency that might have pulled him over. It makes no sense.
 

I watched Frank return to law enforcement. He was a little rusty, slow and confused a little, but I saw it go away. He has turned out to be a good cop, a friend and a person who can make LCSO a respectable office again.

For all you anti-Rivero guys, ask yourself a question. If Rivero said anything in his comments about racial injustice inside LCSO, than why hasn't Mitchell or ANYONE in management gone after him for being untruthful? The answer, he IS truthful and that is why you don't see the EEOC findings.

This is easy to answer if you read the report again. He had already been out of state with the weapons and since he was fired, he had no reason to return to LCSO or have contact with them. I've made a lot of arrests in my lifetime and I can't tell you how many suspects have I forget it was there, I didn't put it there or I was going to turn it in.
