Deputies, off-duty officer nab jail escapee Thursday

LAKEPORT – An escape attempt from the Lake County Jail on Thursday night was halted within minutes by some very observant sheriff’s deputies and an off-duty Ukiah police officer who were fortunately in the right place at the right time.


Mitchell Hughes Lewis, 54, of Lower Lake was the inmate whose alleged escape attempt was foiled, according to a report from Capt. James Bauman.


At about 8 p.m. Thursday night, an on-duty patrol deputy and an off-duty deputy, who had just completed an arrest and control training class, were talking outside of the jail when one of them spotted a man in denim jail clothing running up an embankment from the facility towards Highway 29, Bauman said.


The fleeing inmate, who Bauman said later was identified as Lewis, turned and looked at the deputies but continued running the approximately 50-yard distance to the freeway, ignoring their orders over a patrol car public address system to stop.


The off-duty deputy immediately pursued Lewis on foot while the uniformed deputy raced to get on the freeway in his patrol car and intercept the fleeing inmate. Bauman said Lewis continually ignored commands to stop as the off-duty deputy chased him onto the freeway and eventually caught up with him in the center median near the Hill Road overpass.


As the off-duty deputy struggled to subdue Lewis on the ground, an off-duty Ukiah police officer who happened to be traveling on Highway 29 stopped and assisted to restrain the escapee until the uniformed deputy arrived with handcuffs to complete the arrest, Bauman said. Lewis was returned to the facility without further incident.


Bauman said Lewis had been in custody since November and was scheduled for sentencing Friday on felon in possession of ammunition and resisting arrest charges.


He later told deputies that he expected to be sentenced for an extended term and tried to escape in order to see his elderly parents before going to prison, Bauman said. A plastic bag containing additional jail clothing and other items was recovered from the shoulder of the freeway near the area of his arrest.


Bauman said Lewis was classified as minimum security and was therefore housed in a minimum security dorm at the jail. He now will face felony escape charges, as well another misdemeanor resisting arrest charge.

Mitchell failed Dinius and the people. Mitchell hasn't changed any, he failed his officer by not investigating Rully's complaint in a timely manner. How was it Dutra's complaint by the same woman was investigated and dismissed. But, Rivero's hasn't been given the same respect. There's no excuse on why it's gone on for as long as it has 114 days, only that Mitchell is using it politically to harm his opponent.

I love it when some incompetent person comes on this site and accuses Rivero of disobeying a lawful order. A lawful order has to be given in a way that the order does not conflict with a statutory law (UCMJ-Blacks Law). Rivero never lost his 1st amendment rights. 113 days have gone by and Mitchell or his GOB's refuses to clear Rivero or charge him. Why? Simple, it is because Mitchell has NOTHING on Rivero and trying to keep Rivero silent during a campaign only helps Mitchell.

Give me one reason to believe Rully's statement had an credibility?

1. She was battered in the head by Rivero? Nope, photo's prove otherwise.

2. She was transported by Rivero? Nope, she was transported by Djurnes.

3. She is credible? Nope, tried this stunt on Durta but didn't work.

4. She needs protecting? Nope, she went public to the press before Rivero was even served.

5. She filed it just after the incident? Nope she waited 1 1/2 months.

6. LCSO aggressively wanted to investigate this? Nope, LCSO waited another 4 months.

7. Rivero might be a danger to the public? Nope, Rivero is not on admin leave, still has his gun, ID and badge.

8. Other witnesses being located? Nope, husband and Dejurnes is still at the same place they were since the incident.

9. There are other victims that night? Nope, only one other female booked that night and again, NOT ONE MARK ON HER FACE.

10. LCSO wanted to protect Rivero? Nope again, Brown tried to order Rivero to shut up and not one deputy including Mitchell has defended Rivero accusations publicly.

If you are a deputy or the wife of one and a female accuses you or your husband of sexual battery in a public form, well over a year since the incident, what would you do? Remember, when Rully accused Dutra of rape she didn't contact the press and it did not take 113 days to conduct that case!

It appears that one of the smartest move's Rivero made in regards to the Rully situation is to expose it this opened the door to Mitchells antics and in fact it was basically calling his bluff. Mitchell never thought Rivero would be so bold. Mitchell was banking on him staying quite and Mitchell being able to control the situation. Didn't happen and everyone one we get advise and information from outside the county said it was the smartest move made in the election so far. Now Mitchell is totally stale mated, he can take no action, he cannot fire him, he has not investigation to do. Bottom line is there is no investigation to be done, the election day is approaching and this has really backfired on him big time. This was a very smart move on Franks part!
 

I was trying to think of a word for the corrupt cops and their wives who walked out of the debate the other night when you watch those punks on the video think of the word "plastic" I think it fits perfect. Weak minded cops corrupt as hell with the silicone wives and all worried about their looks, the boys cute little haircuts, and the sunglasses kicked back on top of the head is classic in its ignorance and a true sign of delusion and lack of fortitude and insight as to how the world really goes round. We would love to get these punk cops away from their little click and their uniforms which they should not be wearing anyway, and may not be soon, and teaching these boys a little street lesson in reality. If Hopkins and/or Mitchell wins reelection I think that "all elected officials" should take a 50 percent pay cut, this includes the BOS. The money the County saves should go into the saving account to pay off the law suits.
 

The first question that needs to be asked is was Rully transported to the emergency room to be examined by doctors? From what she said on the radio her leg was so bad she almost had to have it amputated. So where are the E.R reports?
 

There aren't any 8:28- nor was there any reports by the medical staff within the jail. Now that is proceedure when being booked! There aren't any! The saying goes within LE if its not written down it never happened!
 

If Rivero wasn't running for Mitchells job, it would have went bye, bye immediately. But when Rivero stood up to Mitchell and his corruption, Mitchell tried to hammer river with it. The injustices that have taken place and continue to take place under Hopkins & company are a travesty to American freedom and have brought embarrassment to Lake County to an international level. Unfortunately it's taken the internet to bring appropriate visibility to the political corruption taking place in your very back yard. I hope Hopkins and Perdock buy a lot of newspapers and are heavy advertisers.

I still have a hard time believing all the crap that took place, questionable actions, and cover-up with the Dinus prosecution and trial. The number of critical incidents that went "overlooked" makes this a case study for political corruption of the worst kind.

Apparently it takes a San Francisco news station to enter the picture to report the facts you choose to ignore because you've taken such a high road in journalism. I'm not asking you to become the next National Enquirer, just report the news, in a balanced fashion.

Now also remember that the Dinius lawsuit will be coming into play, and that is going to be a fun one the citizens are actually going to get to fill the court room and watch both Hopkins and Mitchell have to take the stand in court. They will be getting hammered by Masson the Dinius lawyer in the civil lawsuit and it is not going to be pretty. So there is much to be done following the election and our plans are not concerned with who wins or loses, it is always about going after Mitchell Hopkins and his weak little side kicks he calls SO's...You know the Frace's. Dutra's,.Martins of the corrupt system, oh so many to name will just leave it at that for now.

If ever there was impropriety's that needed to be looked at by Mr. Jerry Brown the attorney general of California. Lake County should be in the forefront. Has the board of supervisors asked for a complete investigation? Not just a rubber stamp. Has Mitchell or Hopkins asked for a thorough investigation? My guess would be NO. The truth needs to come out so this government can move forward,if not the stench will be with us a long time. I would like to know that my leaders are not dishonest. It is I do not know the whole story and my past involvement with this government has tainted my view of bureaucrats in general
 

There was a DUI checkpoint set up last Saturday, it was discussed here and we never saw any results of what happened during that check point. As you recall the last one had 157 cars go through only 2 minor .08 arrests but several on immigration papers. So this was a check point on the 24th of April and we usually get a report in the media as to how it went. Anyone have any information on this and why nothing was reported?
 

Listened to the debate yesterday. Sounds like Rivero did a good job. A couple of corrections from Mitchell's statements.

Evaluation:
Yes deputies are graded by arrests made. Don't let Mitchell steer you wrong. Gary Hall was the most aggressive sergeant who pushed this. He pushed that so much that his entire shift shut almost completely down. Here is how it works. Deputies are graded in several categories. One is Field Performance. Sergeant's collect data on the total amount of arrests made by the deputies on his shift. Than he adds the total amount of arrests a deputy has made. The sergeant than calculates the percentage of arrests and states on the form if the deputy is Below, Above or Exceeds Standards.

So as you see, there is a quota for arrests.


Bus drivers funding:
Although Mitchell was right that the county does not pay for a bus driver, he failed to see the point. Rivero only touched on this and I think it might have been overseen. Law suits cost the county money. That was the point. Although Mitchell has kept the Sheriff's Office on budget, when those suits such as Dinius, Beland, Garzoli's screw up and what ever Rivero does will be paid by the county and the Sheriff's Office is the county.

Minorities in the Chain of Command:
Mitchell was not right about Crystal Esburg. She is a Correctional Officer, not a deputy and doesn't even manage the jail. Once again, there is NO minority in the Sheriff's chain of command.

We need a change and that's Rivero.
 

114 days and still Mitchell hasn't spoken to the 2 witnesses that could dismissed Rully's accusation in minutes. It is used only to politically harm his opponent its for no other reason.

Two corrections concerning Post 10:31 am.

First, stating that Mitchell has kept the S.O. on budget, I think that is a bit misleading. Every year he would go back to the BOS and ask for additional funds to cover overtime. The BOS would authorize the increased funds and it would be added to the S.O budget. I don't call that keeping it within budget, I call that having extra monies added to the budget.

Next, yes Crystal Esberg is a correctional officer. But, she is a Captain. She tested for the position and became the first person from corrections to become a captain and the first female in that position. Here is where there is a problem. Mitchell does not include her in his staff meetings (unless things have changed in the past year) and he has "rat holed" her. He stuffed her into a corner room and has her do jobs that a deputy or sergeant could be doing.

Mitchell is wasting her talents doing menial tasks and wasting taxpayers money.

To be fair Eyerly (Esberg) did manage the jail at one time. Under her command there, many quality people were gotten rid of in the same ways that everyone is complaining that Mitchell does.
 

you gotta figure it takes approx. 2 weeks after a debate to show up online for you to listen too. Our media has failed us by chosing not to report on the debates. How can decent folks make good decisions w/o the tools? You can't and most seniors send there absentee ballots in while everyone else is still waiting for the next debate to be loaded online.

Good point about the budget stuff and I completely forgot about that. I can't tell you how many times I would see Mitchell and Marybeth begging the BOS for more money. My comment was simple, lawsuits must be paid by the county. LCSO caused them and we the people pay for their incompetence.


As I said, Esburg is a Correctional Officer. Never been a deputy nor has she been through a full academy (just a reserve). You are right, she is kept in the dark and basically doesn't do a thing. If you (bloggers) listen to Mitchell's comments about how proud he is of his command staff, seems he leaves Esburg out of that until Mitchell tries to defend his appointments on gender to his advantage. Esburg was once in charge of the jail and that is what she was promoted for, but now you have a DEPUTY (Capt. Bauman) running the jail. To be politically correct, there are NO minorities as supervisors in the deputies chain of command. Mitchell, Brown, Howe, Garzoli, Perdock and all the sergeants are WHITE MALES.

To think that what they are fighting is a model that has the LE and citizens working in concert with each other, identifying priorities, creating long lasting relationships, a transparency of information, allowing the shared knowledge to clean up the crime at this lake, and set standards of cooperation our current BOS does not appear to even fathom. But the entrenched elitist those who feel they have power LE and government alike are fighting that ideal while what they are doing is crumbling around them...The emperor has no clothes!
 

Today at approx 3:15 P.M. A sheriff Patrol car was northbound on hwy 29 just north of parkway. His speed was somewhere between 85 to 100 MPH, NO emergency light we're activated, he was passing cars in both lanes (the slow and fast lines). On this Mothers Day, I pray that he does not kill a mother or anyone else. Way to fast
 

3:58 It was probably the same clown who was driving the wrong way down Hwy 29 about a month ago - lights and sirens going- then skidded around the light at Kits Corner to assist in the Riv's with a kid evading on a motorcycle. The problem I have is I was listening to my handy dandy handheld scanner and Ski who happeded to be chasing the felonious kid thru the streets had lost him and had called off all the responding deputies, not 3 minutes after hearing him call off the chase, here comes clown boy putting everyone on the road in danger due to his assnine driving for NOTHING!!! The response had been CALLED OFF! He was speeding to assist with a guy who refused to stop for a cop not a homicide suspect so why was clown boy driving like a ass*ole... oh I know because he could.. he's the law and if he wants to drive fast down the wrong side of the road well what are we gonna do about it...fricking jerk off!!

The one other thing you will notice on the debate is the 8th question or so talking about a direct order was a set up by Liz and John trying to set up Frank, boy did it back-fire on them and Mitchell. Both Rivero and Baxter beat up Mitchell on that one. Nice Try John and Liz, but it didn't work!!

Part 2..Although we may not agree on his total overview of Anderson/Rhodes we acknowledge there may not be the total "in house" picture as we have, none the less a great second part.


In regards to the DA candidates, Hopkins clearly comes across as a heavy handed Nazi, which his past actions have already confirmed. Either opposing candidate seems very capable, and Rhoades carried himself quite well and seems very qualified.

In terms of Sheriff candidates, Mitchell hid behind several issues, apparently due to the legal obligations of his position, but Rivera did a great job in clearly pointing out all the "irregularities" that have taken place within the department, including detailed specifics of the highly questionable IA investigation against the alleged claims against him in an arrest which have gone totally unanswered for ~ 110 days. More importantly, he provided solutions to the issues. His performance in the second debate is well worth watching, and I believe he did a good job of highlighting several examples of corruption in the department, including among other things, performance evaluations based on arrest quotas, which is apparently illegal. I'm not an expert, but Baxter seemed to agree.

The other candidate, Jack Baxter, a 38 year veteran from the San Jose police department, is in the race for different but interesting set of reasons. He retired from San Jose and moved up to Clear Lake to enjoy life. Once he relocated, he realized the new community he lived in had some real political, leadership and corruption issues with local law enforcement, and decided to run against Mitchell specifically for those reasons. Good for him, and he seems well qualified to provide the experience and leadership the department is lacking since Mitchell showed up.

Interestingly, both incumbent candidates categorically rejected any form of citizen or community oversight to their departments, and all the opposing candidates overwhelmingly supported it. Very telling.

The other interesting point was that everyone seemed to accept the fact that budgets were under pressure, and would likely come under increasing pressure, only the challengers (all of them) recognized why - lower taxes due to lower residency and lost tourism due to negative publicity with the Dinius case, but Hopkins confirmed more than once he would have still pressed on. Frigging pig headed political idiot.

The expression is "Go to Lake County on vacation, leave on probation". Pass the word.

Not sure why the local news media couldn't have reported any of this to the interested public, but I thought it worthwhile to pass it on.

Why would Mitchell not say Perdock and Garzoli are gone (if they are)? If Garzoli and Perdock were terminated, it would show the Mitchell is serious about cleaning house. But just like the 118 day IA against Rivero, Mitchell just does not know what to do and his management is too unskilled to do anything.

It is simple, Bauman is the only experienced manager but he is running the jail and you don't hear any problems there.

Then you have Howe, Hall and Brown. Neither has the educational background that would be required by another agency around Lake County, such as Napa, Sonoma, Mendo or Glenn. Hell, Brown never even supervised any deputies as a sergeant or even been a detective! At least Howe worked NTF and Hall was SED.

In the last debate, Mitchell said Kelly Cox was a great partner on working budgets. Okay not exactly but you get the drift.

Well if Kelly Cox is such a great partner, why does he not endorse Mitchell? That's right, you will not find Kelly Cox or Rob Brown, Smith or Rushing. Also Anetta Grant or any judge has endorsed Mitchell.

I am a part time resident of Lake County and a property owner, I am registered to vote here. My "regular residence" is the S.F. Bay Area and I am active in the sailing community. I am also active (but not sworn) in law enforcement. I think I have certain qualifications to make these observations.

Mitchell has the backing of his crew because he is somewhat detached from what they really doand being young and high energy, they like it this way. They DO NOT want oversight. What they really do is quite a bit like LE from the 50's through the mid 70's. Bust the bad guys, harass the minorities, and smile at old women, kiss babies. In Lake Co. that is what the people who count want. Further, unless you just hate cops for any reason, and you have lived in Lake Co. all or most of your life, you think this behaviour is normal. Also, the average person of some means in Lake Co, doesn't ever see himself having to deal with a sheriff's officer in an adviserial situation. So, who cares how they get the job done, "just keep the crack heads from my door." Mitchell, up until now, could not care less how his staff handles things, he gets re-elected and all is well.

Now, suddenly little old Lake Co is in the news. A high ranking SO hits and kills a woman. The DA in a very stupid act, charges the wrong guy. The bay ares news agency's get wind of a good story and BAM, Mitchell is in the news. Rampent gossip prevails, no one has any facts, and people start talking about just how the SO works. They remember two black guys who get shot running down the street, and their buddy gets charged. What the hell is going on up there?

So, fast forward to today. The "people of means" want it all to go away and they want to be assured that the crack heads won't be allowed in to "their part of town". They don't give a damn abut racial profiling, beat wives, equal opportunity hiring and all that troublesome stuff. "Just keep those ass holes off my street."

Now, who supports Mitchell and who votes? Most of the same people. They pour the money into his campaign, they put up signs, they wink when the local paper all but ignores the issues. Remember, they are the ones who support the paper with their advertising dollars, not the Hispanics, not the Indians, not the fixed income who rely only on SSI.

Bottom line, Mr Rivero has a high hill to climb, not much time left to make it to the top, and his main issues are not of much concern to those who count. So, Mr. Rivero, get out there, look competant, less acrimoney, and more details about how you will do two things. 1. Bring the LCSO into the 22st century---AND keep those GD druggies in check.
 

perdick murdered Lynn Thorton and Rodney Mitchell gave the order to the deputies that the sailboat lights were off and they were ordered by Mitchell to protect perdick . By following orders those officers committed the following crimes Accessory to murder , obstruction of justice , Perjury , Witness tampering all these crimes were committed under the authority of power . All these crimes qualify this case to be tried by under the rico act .

Everyone has a story to tell they just want someone to listen. Frank is doing alot of that, and truly this is a grass roots campaign. There are a number of sub-demographics you have left out of your overview, As well you did not point out the massive get out the vote and signing up of the Hispanic and American Indian citizens that is taking place. We agree with the overall post and most of your overview, There is quite a bit going on behind the scenes in contacting and speaking to people. And in the end you are correct it will be critical to run all the way to the end, and touch as many people as possible.

It is not staying neutral, it is that they do not support Mitchell. Brown was at the debate, yelled out but still would not support Mitchell. It is common for a political person to endorse another. In this case they don't want any connection with Dinius/Perdock and Garzoligate. Even the slightest involvement could be destruction for any BOS.

Rivero should stay mad, I would be too if my boss wouldn't do his job and clear me or charge me. It was a dirty low down disgusting thing Mitchell did. When Rully complained about Dutra, it was investigated and he was cleared right away. Oh but when it is Rivero, the GOB's wait four months after the complaint was filed to even start it. No injuries on the booking photo, no interview of the accused or witness, no review of the booking documents and Rivero wasn't even the transporting deputy! HELL YES HE SHOULD BE PISSED AND I'M PROUD HE IS TAKING A STAND AND SHOWING THE PUBLIC EXACTLY WHAT MITCHELL AND THE GOB'S ARE MADE OF.

Also, lets not forget about the little old EEOC complaint Mitchell still refuses to release.

Mitchell ran on the platform that LCSO was to top heavy. As soon as he became Sheriff, he cut the captain and lieutenant positions. But just a few years ago he brings them back. And how about that Lieutenant position? When it was last opened, only Hall applied because nobody else wanted to be in management. The other two (yeah TWO, last filled by McMahon and Garzoli) still had not been filled. Hall got it by default only.

I havew never seen a worse orator in my life then Mitchell, he fumbles around can't remember to turn on his mike, tries to use to big of words in the wrong context can't quite pronounce them and goes off on these odd tangents in the middle of his conversations, you get the feeling he is trying to be smart, or like he studied his answers and now is trying to re-state them. I got the same idea from Mitchells speaking technique it is sort of like bad acting. You just get the sense you cannot trust the guy, that what he says is less then truthful, always seems like he is trying to cover-up or act but it comes across so poorly.

Lake Co, needs a Sheriff with leadership. A Sheriff that will lead the Department out of the crap, Sheriff Mitchell has done to it. A Sheriff that will hold all employees accountable for their actions fairly. A Sheriff that will set Performance standards that applies to everyone, from Command staff, down. A sheriff that is open to the public, not just in election years. A Sheriff that will NOT protect his friends and supporters within the Department. A Sheriff that will take down the wall Mitchell was built between that Citizens of Lake Co. and the Department. A Sheriff that will rebuild trust with the Citizens. I believe Frank Rivero is that man. He stood up to Sheriff Mitchell and Mitchells corruptions.

The Bayles letter in LCN just beat the hell out of Mitchell and Hopkins and the clarification was good to hear, Joan did a good interview and this was a good follow-up. There was one statement that did not ring true and that is toward the end of the letter where she indicates we should seek out the media coverage on the election, well of course there is no media coverage not even on the debates...So wish the citizens could do that but not in this county where a media blackout has been imposed. Well none the less, the citizens are coming to this site and finding the information and coverage they need, and we are happy to be providing that information for them. We don't think LCN would have even published that letter with the exception of the fact that they would look even worse if they turned down the request to post it, we suspect they would have wanted to but could not find a way around it.

I know other jurors also support Rivero . The biggest disappointment of the trial was the jury did not get to go out on the water in a sailboat on a pitch black night . Then they would really know how ridiculous the charges were .

People, the elections of the Sheriff and District Attorney are non-partisan elections. No one has to change their party affiliation. The ballot they receive will be the same whether they are a republican, democrat or an independent.
